RECITALS : � � � A. HCWA awns that certain parcel af land situated in or near the City af IGp Renton{the "City"), County of King, State of Washingtan, which parcel is more particularly i � deseribed on E�ibit "A" attached hereto and made a part hereof{"Parcel A"}. � � B. HCWA also awns that certain parcel of land situated in or near the City, � � I t� County of King, State of Washington which parcel is more particularly described on Exhibit "B" � hereto and made a part hereof("Parcel B"}. Parcel B is adjacent to Parcel A. � C. In connection with HCWA's develapment of Parcel A, including, without limitation, the development of a building upon Parcel A{the "A-Building"}imznediately adjacent to the northern lot line of Parcel B, the City has required that HCWA, as the owner of Parcel B, , agree to certain restrictions upon the development of Parcel B. ' WITNESSETH : hy �1 � In consideration of the foregoing recitals, HCWA hereby agrees as fallows: ' l. Buildin�Location. In the event that HCWA desires to construct a building � upan Parcel B (the °B-Building") or sells, assigns or transfers Parcel B ta any buyer("Buyer"), HCWA shall Iocate, or sha11 require Buyer and its successors (in the event they desire at any time �4 to construct the Building) to locate the B-Building either(i) a minirnum of sixty feet(60')frorn � � the northern lat line of Parcel B or(ii) immediately adjacent to the northern lot line of Parcel B. Successors and Assi�ns. The provision of the Agreement will inure to the benefit of and will bind HCWA and its respective successors and assigns and all other persons or entities which acquire any interest in Parcel A or Parcel B. 3. A�plicable Law. This Agreement will be construed in accordance with and enforced as provided under Washington law. 4. E�ibits. Each of the E�ibits attached hereto is incorporated herein by reference. - 5. Captions. The paragraph captions in this Agreement are for convenience only and are not a part of and are not intended to govern, limit or aid in the interpretation of any provision of the Agreement.
