HomeMy WebLinkAboutA 06171914114 H15 AGRB3,1ENT, Made and entered into this day of ._t, 19140 by and between the PUGET SOUND TRACTIOU, LIGHT, &a POWER C01JP-JTY, €, Massachusetts corporation, hereinafter called "Power Company", party of the first part, and the CITY OF RENTOR, a Municipal corporation, hereinafter called "City", party of the i second part, WITHESSETH! That the City of Renton having accepted the bid of Power Company by vote of its City Council on the seventeenth day of March 1914, hereby contracts with Rower Company as-follows: FIRST: The Power Company agrees to furnish for the use of the City, and the City agrees to use and consume from the Power Company, such number of incandescent lamps, (save and except lamps used by the City under Section Fourth hereof), with current to light the same, as the City may during the life of this contract require for lighting the streets, avenues, public parks, and public places, and such public buildings as the City may direct, and for all other municipal lighting, said lights to be located by the Com- pany at such points in the streets, avenues, public parka, public places, and in such municipal buildings as the City by its ,I&yor or other properly constituted enthority may in writing designate. SECOND: The City agrees to use all said lamps and current and p y for the same for the term of two years, beginning trttftht 19149 and ending �'�, 1916. t THIRD: The City agrees to pay for all such lames and current used in lighting its streets, avenues, public parks, and public highways (save and except the lamps used by the City under Section Fourth hereof) at the following rates: RATED CA,N: MPOWER WATTS PRICE PER MONTH 60 65.3 $1.10 80 81.8 1.40 100 100.3 1.70 2W 198 3.40 350 346.5 5.40 Each monthly payment due the Power Company under this agreement shall be paid by the City on or before the tenth day of the following month. FOURTH: Power Company agrees to furnish to the City, free of charge, sufficient electric energy at nominal 110 volts to operate twelve 16 candlepower incandewcent lamps to be used in the F.iunicipal buildings of said City. FIFTH: Power Company agrees that it will install all streot lamps as the same may be ordered by the City from time to time during the life of this contract, provided, however, that all costa of installation shall be paid by the City, including the cost of erecting new lines, provided., however, that the City may at its option erect its own limes and install its own lamps in place of paying said Power Company for doing so. SIXTH: The City shall pay for the first installation of each lamp as hereinbefore set out, but Power. Company agrees to furnish renewals of unbroken burned out lamps at its own expense and to bear all costs of maintenance, repair and operation after such first installation, except the replacing of broken lamps. After the position of a lamp shall have been designated by the City and the same installed, any removal to a different lo- cation shall be at the sole cost of said City. SEVENTH: Power Company agrees to operate all of said lamps and arcs from the cessation of daylight in the evening un- til the coming of daylight in the morning upon each and every day of the term of this contract. JUGS Power Company during the life of this contract may have the privilege of stringing and maintaining its service wires on any poles ovined by the City by payment to said City of an annual tental of One Dollar ($1.0(}) for each eight (8) pin cross arms or any part thereof used by said Power Company and Fif- ty Cents (0.50) for each four (4) pin cross arms or any part there- of used by said Power Company; provided, however, that no charge shall be made for the service wires of said Company installed prev- ious to January 29,1911, and in place on the poles of said City; provided further that such use of the poles belonging to said City shall not interfere with the proper use and enjoyment thereof by said City or its assigns. All cross arms installed by said Power Company on City poles to be installed at the sole cost and expense of said Power Company and upon failure of said Power Company to pay the annual rental herein provided for, such cross arms so install- ed shall be and become the property of said City. Upon payment of a like rental the City shall have, dur- ing the life of this contract, the right to string and, maintain its wires upon the poles of Power Company, provided that such use of 3. said poles shall not interfere with the proper use and enjoyment thereof by Power Company or its assigns. NINTH: In case of the failure of said City to pay for all service rendered under this contract as herein specified, Pow- er Company, may, at its option, discontinue service hereunder. TENTH: The Company agrees to use due diligence in main- taining all lamps and appurtenances in good condition and proper working order. The City agrees to notify the Company through the Company's representative at Renton of the failure to burn of any street lamp installed under this agreement. In case the Company is not so notified, no deduction from the monthly payment next due the Company sha.11 be made for such lamp failure. In case the Company is so notified, and fails to renew such lamp within twelve (12) hours after the notification is received, a pro rata reduction from the time such lamp was out shall be made from the next monthly payment shall due the Company, and in no case such ddduction amount to less than ten (10) cents per lamp per night for each lamp reported out. ELEVENTH: The city agrees to use electric current, to be furnished by the Company under this agreement, for all illumination of the City's streets, avenues, public parks, public buildings, and for all other municipal uses for which illunin�ttion is required, dur- ing the entire term of this agreement. TWELFTH: In case the Company's rates for similar street lighting under 93imilar conditions are reduced, the City shall be given the benefit of such reduction beginning with the next following monthly period from the date of such reduction and thereafter until the termination of this agreement. The City a- grees to pay for all lamps and current used in lighting the public huildings of the,City at the regular published.domnercial lighting rates of the Company, save and except lamps used by the City under Section Fourth. hereof. In case the regular published commercial lighting tater of the Company are reduced, the City shall be given the benefit of such reduction, beginning with the next following monthly period from the date of such reduction and thereafter until the termination of this agreement. THIRTEENTH: The Company further agrees that should a Atw and improved form of Mazda lamps for street lighting come in- to general use e-uring the life of this contract that it will permi the City to install such new and improved form of Maeda lamp or oth- er lamp of equal efficiency as generally used in the City of Seattle or elsewhere, and the Company will thereafter maintain them as pro- vided for in Paragraph :Five of this agreement; provided, however, that such new lamp shall be approximately the sane wattage and cost as the one for which it is substituted. F7URTEENTH: Reasonable diligence to be exercised by Pow- er Company to provide an uninterrupted supply of electric energy and no interruption in the service or temporary,failure to furnish said energy shall cancel this agreement. 5. In case of interruption caused or made necessary by accidents, public servants, strikes, conditions beyond Company's control, lack of capacity in its generating apparatus, Company will not be liable for damages and City agrees to give Company immediate no- tice upon learning of any defects in the service or apparatus.
