Fontes, Senior Assistant City Attomey SUBJECT: Temparary Status I learned yesterday from the police department that the Civil Service Comtnission had asked for a legal opinion from the city attorney's office regazding the interpretation and the appiication of CiviI Service Rule 13.01. I contacted Eileen Flott to inquire regarding the question you wanted answered. My understanding ofthe question is: May the police department assign a current employee to a temporary assignment, which assignment is to fill in for an individual who will be temporarily working for SCORE (the South County Correctional Facility)for an indefinite period? I might not have understood the question accurately from Eileen. So, if my understanding is in error,please do not hesitate to call rne at(425)255-8678. I have reviewed Rules 13.01 and 13.02 of the Civil Service Rules for the police department as well as RCW49.44.160. It is my opinion that the police department� appoint a cwrent employee to a Temporary Appointment(Rule 13.01)to fill the position thai will be vacant while Penny Bartley goes to work for SCORE. In my reading of the ruies,I have concluded that this is not a provisianal assigrunent. Tliere is no emergency that e�usts,which is a condition of the applica,tion of Rule 13.02. For earample, there is no sudden vacancy of this position that needs to be filled immediately(there aze four(4)definitions for"emergency"in the rule)and we have no eligibility list and we need to buy some time to go through the hiring process. Insofar as your question relates to the duration of the Temporary Assignment, my interpretation ofthe rule follows. Rule 13.01 provides that"[a] person may be employed in a temporary position only for the duration of the appointment." I interpret this to mean either oftwo things: 1)the temporary assignment ends on a date certain;OR 2)the temporary assignment ends on the occurrence of a specific event(i.e., Penny Bartley's return to work to the city, or her resignation from employment with the city). � � � Mr. James Phelan Renton Civil Service Commission 7 January 2004 Page 2 of 2 As you lmow,state law has a provision that prohibits tlie use of a"ternporary" classification(by government)as a�ans to avoid providing be�fits to the temporary employee. (RCW49.44.160.) As the city will be assigning to the vacancy an individual who will be covered by city benefits(a curr�t regiila,r employee),I am of the opinion there is no violation of RCW49.44.160.
