EASEMENT
The Grantor, PACIFIC COAST R. R. CO. , a Washington corporation,
herein called the "Railway Company," for and in consideration of the

Kinc� State of Washington, to-wit:
A,11 th.at part of the right of way of the railroad of
the Pacific Coast R. R. Co. in Government Lot 6, �
� Section 1.6, Township 23 North, Range 5 E.W.M., King
County. Washington, being a strip of land ,].O.00. feet
in width,,, the centerline o� said strip crosses the
- centerline of main track of said Railroad at Survey
Station 731+54, all as more particularly shown colored
green on E�ibit "A" attached hereto and made a part

The Railway Company, its successors and assigns, reserve the
right to use the property hereinbefore described for any and al.l
purposes not inconsistent wi�h the easement hereby granted, including
but not limited to the right to construct, maintain, repair, renew,
reconstruct, replace and operate present tracks and future tracks,
communication and signal 1.ines, and other facilities on said lands
.► when deemed necessary or ex,pedient to the Railway Company. Rights

The rights herein reserved by the Railway �ompany shall be
paramount and superior to the rights granted to the City. In the
� event the Rai3.way Company's use of said lands requires any change
� or modification of the City`s facilities installed on said lands,
�
�� the �ity shall an demand of tn.e Railway Company change and modi£y
�
� such facilities to accommodate the Railway Compan.yxs use at the
City"s sole cost and e�ense, and the City does hereby indemnify
and hold the Railway Company harmless of and from any cost, expense
or damage to the �ity' s facilities located on said lands or the loss
of use thereo� by the Gity by reason of the exercise of the rights
herein reserved,

In the event o� vacation or abandonment, or termination of
this easement by good cause shown, the Railway Company shall thence- '
farth hald and enjoy ti�tle to its right of way free and c2ear of I
the easement hereby granted, and may at its option re-enter„ re- I
take and hold said land and premises as of the present estate of
said Railway Company, without com,pensation to the City,. the publ.icr
or any other person whomsoever, for improvements or property removed,
taken, ar destroyed, or liability for loss of or damage to any
premises or the impravements thereon abutting said water line or
any part thereot.

The City agrees �o indemnify and save harmless the Railway
Coznpany of �nd from any ar�d all. loss, �.iability, cost or ekpense
in connection with the construction. maintenance and operation of �
the water line for which this easement is granted.
VI
This agreement shal]. be binding on the successors and assigns
� of the parties.
