The Grantor, PACIFIC �COAST 12.. R. CO., a Washington corpora-
tion (herein called the "Railway Company") , for and in consideration
��ot the sum of �ne Do1l.ar ($1.00) , receip� whereof is hereby acknowl-

s�,,�edged, subject to the reservations and conditions herein set forth,

�does hereby grant to the CITY OF RENTON, a municipal corporation of
the State of Washington (herein called the "City") , Grantee, an ,
�asement for the construction, maintenance and operation of a water
line under and across the following described property si.tuated in
the County of King, State of Washington� to-wit:

"� A strip of l.and 2Q feet in width, measured at right
angles to the sides thereof. the southerly line of
said strip being also the northerly line of the 100
foot wi.de right of way of the Northern Paci�ic Railway
�ompany in the South 1/2 of the NE 1/� of Section 24f
Township 23 North, Range 4 Last, W, M., �ing County,
Washington, extending easterly along said northerly line
from the intersection thereof with a line para�.le]. with
and distant 470 feet easterly, measured at right angles
from �the north-south center I.ine of said Section 24
(said line being the east line af that certain property
�onveyed by the Pacific �Coast R. R� Co. to the Munici--
pality of Metrogolitan Seattle by instrument recorded
as Auditor«s File No. 5306156, records of King �ounty)
to �.ntersection with a 1.i.ne distant 285 feet easterly.
and parallel with said �east line of the Municipality's
property,
TOGETHER with a temporary easement for a period of six (6) '
months from the date hereof,� over and across a strip o£ land ten (10)
feet wide adjacent to and abutting on the north margin of the herein-
above described premises for the purpose of constructing said water
line.
,.__ The easements herein granted are made subject to and upon
the following express conditions:
I.
The Railway Company, its successors and assigns, reserve
the right to use the property hereinbefore descra.bed for any and
all purposes not inconsistent caith the easements hereby granted,
- including but not limited to the right to construct, maintain,

. repairx renew, reconstruct, replace ax�d operate present tracks and
future tracks� communication and signal 1.ines, and other facilities
, on said lands when deemed necessary or expedient to the Rail.way
Company. Rights reserved shall be so exercised as not to damage
or interfere with the water line or any part thereof, except as

''� These easements are suhject to existing interests in the gremises
of whatsoever nature and any and all extensions and renewals thereof.
III.
The rights herein reserved by the Rai].way Company shall be
paramount and superior to the rights granted to the City. In the

e en he R zl ay Comp ny use of said lands requires any change or
� modification o� the Ci.ty's facilities instal.led on said lands, the
I City shall on demand of the Railway Company change and modiz"y such
facilities to accommodate the Railway Company's use at the City� s

sole cost and expense� and the City daes hereby indemnify and hold
the Railway Company harmless of and from any cost, expense or damage
to the City's facilities located on said lands or the loss of use
�hereof by the City by reason of the exercise of the righ�s herein
reserved.
1V.
In the event of vacation or abandonment, or termination of
these easements by good cause shown, the Railway Company shall. thence-
forth hold and enjoy title to its right of way free and cl.ear of the
easements hereby granted, and may at its op�tion re-enter, retake and
hold said land and premises as of the present estate of said Rai.lway
Company, without compensation to the City, the public� or any other
person whomsoever, for improvements or property removedt taken, or
destroyed, or liability for loss of or damage to any premises or the
i.mprovements thereon ahutting said water iine or any part thereof.
