The rights herebyr granted are sub�ect, however, to such use of the
above described premises as the Railway Company may wish to make not incon-
sistent with the grant hereby made and to permits, leases and licenses here-
tofore granted by the Railway Company across, within or along said premises.

drainage of the Railway Corripany�s property in connection with construction '

by reason oi any failure of the City to provide such drainage and to indem-
nify and sane harmless the Railway Company from any claims of third persons .

In the event the construction or maintenance of said highway taay
interfere with or create a hazard to the communication, signal, or electric-
power lines, called ►+facilities4� i.n the rest of this paragraph, of the Rail- `�'
way Company, The Western Union Telegraph Company or any other party using the � �
l�ailway Compan�'s property, the �ity or its contractor shall give t,he Division ` �
Superintendent of the Railway Company at Tacoma, Washington sufficient advance .
notice of such possible interference or hazard to anable the R.ai.lway Company ,
or its permittees to permanently relocate or temporarily relocate and perman- " ~
ently restore the affected facilities at its or their option. In the event
the Railway Company, itg permittees or any of them shall permanently reiocate
or temporarily relocate and permanently restore the affected facilities� the
City shall pay all cost of such work, including maintenance of any temporarily
relocated facilitiea, upon receipt of bills therefor. The City shall also pay
to the Railway Company or its permittees, as the case may be, the cost of re-
pairing or replacing the facilities on account of damage to or destruction of
the facilities arising or growing out of or in any manner connected with con-
struction or maintenance of said highway.

Upon presentation of bills •therefor� 'the Gity shall reimburse the �--
Railway Company for any and all costs and expenses incurred by the Railway

penss ineurred by the Railway Co�pany in making changes in its facilities� ${�gr ����
including the cost of moving or recon�tructing ar�► bvildings, changes in p�q �� i�,

highway, regardleas of whsther such loss,_ cost, damage or expense arises out
of damags to or destruction of the propertg of the Railway Company or aq�y per-
son, firni or corporation Whatsosver� or out of claims for personal iz�juries

The City shali not grant to any person or compar�y permisaion to con-
struet or ma�irita� a pole line on any portioa of the above described premises�
the Railaay Compar�y hereby reserving to itself the right to grant such per�nit�
. provided t�e pole lines are ao located as not to interfere s�aiith the use of the

in said premises of whatsaever nature and any and all extensions or renewal�

from combustible materials and to cut and remove or caus-e to be cut and re�oved
at its sole expense all weeds ancl vegetation on said premises at such times and
in sueh iaanner as to be satisfactory to the Railway CompaTay arid as to abate ar�y
and aIl hazard of fire.

The Ra.ilway Company shall not be liable or assessed for any of the
e�ense incurred hereunder hy the City.
