hereinafter called "Grantor(s)", and the CITY OF RENTON, a Mtmicipal Corporation
of King Coi.mty, tit'ashington, hereinafter called "Grantee".

do by these presents, grant, bargain, sell, convey, and warrant tmto the said
�rantee, its successors and assigns, a temporary construction easement fox a public
utility (street improvement) with necessary appurtenances over, through, across and
upon the following described property in King Cotmty, Washington, more particularly
described as follows :
,"A temporary construction easement 40 feet in width over the Southerly 40 feet,
measured perpendicularly to the Southerly line, of the following described property:
'I'he West 152.30 feet of Tract 259, C. D. Hillman's Lake Washington Garden
of Eden Division No. 4, according to the plat recorded in Volume 11 of plats, page
82, records of King Cotmty, 4Vashington; LESS the North 96 feet thereof.
Said temporary_ construction easement shall remain in force during constructio� ,
and i.ui�il such time as the street improvement has been accepted for operation and

Sai d heretofore menti oned grantee, i ts successors or ass.i gns , shal l
have the right, without prior notice or proceeding at law, at such times as
may be necessary to enter upon said above• described property for the purpose
of constructing, maintaining, repairing, altering or reconstructing said
� utility, or making any connections therewith, without incurring any legal
obligations or liability therefore, provided, that such construction, main-
� taining, repairing, altering or reconstruction of such utility shall be I�
�` accomplished in such a manner that the private improvements existing in the right
,�.� right(s)-of-way shall not be disturbed or damaged, or in the event they are
dis turbed or damaged, they will be replaced �n as good a condition as they were
immedi ately before the property was;�entern,d upon by the Grantee.

The Grantor shall fully use and enjoy^the afot^edescribed premises,
including the right to retain the right to use the surface of said right-of-way
i f such use does not interfere wi th install ation and maintenance of the uti 1 i ty
line. However, the grantor sha;l.l, not er.ect bui,ldings or structures over, under
or across the right-of-way during the existence of such utility. ,

This easement, shall be a covenant running with the land and shall be bind-
ing on the Grantor, his successbrs , fieirs and assigns. Grantors coVenant that
they are the lawful owners of the above properties and that they have a good and
lawful right to execute this agreement.
