O �� Grantee warrants and covenants as follows: �7 A. The legal description of the location of the utilities correctly describe� the future location of tne easement and in accordance with plans dra�en and shown to the Grantor. B. That the area involved has been surveyed- by a licensed surveyor and the survey shows that the maps and drawings prepared, in , connection with the said sewer Local Improvement District No. 267 project, agree with the physical facts and legal descriptions herein. Said temporary construction easement shall be extinguished by Ordinance passed by the �2si��on City Council and filed for record at such time as the utilities and appurtenances have been accepted for the operation and maintenance by the Grantee or not later than December 31, 197� whichever shall first occur. ` In the event that the Grantor ever has to go to court to enforce any of the provisions herein and the Grantor prevails in such action, the Grantee will pay reasonable attorney fees as determined by the court. / . , . � ,,z,, ' . .. . ,- -� � , . � -- ., } . , ,. ti ^ .
