HomeMy WebLinkAboutE 7202040357 _ _ , �_ , , ., < • • � � ° E A S E M E N T � � THIS �:1DEN1[1RE made this�i,.,,��day of , 1972, between PUGET SOUND POWER � LIGHT COMPANY, a Washington corpa tion, erein called "Grantor", and the CITY OF RENTON, a M�icipal corporation, herein called "Grantee", WITNESSETH: That in consideration of the sum of One Dollar ($1.00) in hand paid, receipt of which is hereby aclrnowledged, and the performance by Grantee of the covenan�Cs hereinafter set forth, Grantor hereby grants unto Grantee, without warranty of any kind, a right of way not exceeding 15 feet in width for the construc�ion, mainten- � ance and operation of the following described service facility: � � A 12-inch sanitary sewer line, �# � within and across the following described .land situa.ted in the CoLmty of King, flState of 4Vashington, `to-wit: - - • - � - _ - _ _ _ � �' The southerly 15 feet of the 100-foot wide Puget Sound Electric right of way in the Southeast 1/4 of the Sou�hwest 1/4 of Section 25, Town- ship 23 North, Range 4 East, W.M. This easement is granted on the following terms and conditions: l. Grantee agrees that said sewer main will be buried at least seven (7) feet below the natural surface of the ground at a11 points, excepti crossing the drainage ditch on the west side of said 100-foot right of way at said ditch the sewer main will be approxima.tely five (5) feet above ground at the lowest point of said ditch. 2. Grantee agrees to notify Grantor 48 hours prior to beginning of construction by calling our operations office at AL. 5-2464, extension 281, Renton, Washington. 3. Said easement shall include the right of ingress and egress to, upon and over said land to construct, maintain, operate, repair and replace said sewer line and also grants to Grantee the use of such additional area imunediately adjacent to the above easement as may be necessary for the construction of said sewer, such additional area to be held to a minimum necessary for that purpose. The grant for - use of additional area shall terminate upon completion of said construction, or no later than September 31, 1972. 4. Grantee agrees to save and hold Grantor harmless from all loss or damage which may be due to the exercise by Grantee of the right herein granted, and from all claims for such damage by whomsoever ma.de, and to inder�mify Grantor for all such loss, damage and claims. 5. Grantor reserves the right to use said premises for its own purposes in any way. Without limiting the generality of the foregoing, Grantor reserves the right at any time, and from time to time, to construct or recon.struct an electrical transmission or distribution system, whether AC or DC; whether now existing or here- after to be constructed, and related structures, upon the premises. If Grantor's use necessarily damages Grantee's facilities, Grantee sha11 have no claim or right of ` reimbursement against Grantor for such damage. ; 6. Grantor reserves the right to grant rights in the premises to other persons provided such rights so granted are not inconsistent with the rights herein granted to Grantee, including wi.thout limitation the ri�t to grant_ to any other person a right of access across any part of said prem-ises. , - � 7. `�i� right hereby granted shall terminate whenever Grantee shall have permanently abandoned the use of said facility and upon such abandonment Grantee shall remove its facility and restore the premises to as good condition as they were in_:prior to the construction of said facility. - 8. Grantee agrees to replace or pay for the replacement of any survey monu- ments or stakes that may be dislodged or removed as a result .of this grant. 9.
