HomeMy WebLinkAboutE 7202040356 ' �� ' .. � J � `� r � � . � � EASEI�IENT , > This indenture made this ;.�day of �,�.��. , 1972, between PUGET SOUND POWER � LIGHT COMPANY, a Washington corporatifon, herein called "Grantor" and the CITY OF RENTON, a Municipal corporation, herein called "Grantee"; WITNESSETH: That in consideration of the swn of One Dollar ($1.00) in hand paid, receipt of which is hereby aclrnowledged, and the performance by Grantee of the covenan�s hereinafter set forth, Grantor hereby grants unto Grantee, without warranty of � any kind, a permanent slope easement over, upon and under the following described property: �p The southerly 12 feet of that portion of the Renton Branch of the � � Puget Sound Electric Right of Way lying west of Ra.inier Avenue � South in the Northeast 1/4 of the Northwest 1/4 of Section 19, � Township 23 North, Range 5 East, W.M. , said 12 feet being 6 feet on � each side of the following described centerline: � Beginning at the centerline intersection of Grady Way and Rainier '� Avenue South; thence westerly along the centerline of Grady Way 110 feet, more or�_less, to City of Renton's Engineering Station 43+34; thence northerly at right angles to said centerline of Grady Way 56 feet and the true point of beginning; thence westerly parallel to the centerline of Grady Way 516 feet and end of said centerline of the southerly 12 foot portion. _ This easement is granted on the following terms and conditions: 1. Grantee agrees to save and hold Grantor harmless from all loss or damage which may be due to the exercise by Grantee of the right herein granted, and from all claims for such damage by whomsoever made, and to indemnify Grantor for all such loss, dama.ge and claims. 2. The right hereby granted shall cease and determine whenever Grantee shall have permanently abaridoned the use of said facility or Grantor, its successors or assigns, brings the lands herein described to the grade of Grantee's nearest pave- ment. 3. Grantor reserves the right to use said premises for its own purposes in any way. Without limiting the generality of the foregoing, Grantor reserves the right at any time, and from time to time, to construct or reconstruct an electrical transmission or distribution system, whether AC or DC; whether now existing or here- after to be constructed, and related structures, upon the premises. If GrantorTs use necessarily damages Grantee's facilities, Grantee shall have no claim or right of reimbursement against Grantor for such dama.ge. 4. Grantor reserves the right to grant rights in the premises to other persons provided such rights so granted are not incon.sistent with the rights herein granted to Grantee, including without limitation the right to grant to any other person a right of access across any part of said premises. � S. Proposed Easement re; Renton Elks Club: You realize that this is an extremely tight easement from the C�.ty's standpainfi by reason of paragraphs 4,5 and 7. You ahould ma}�e the detex�minat3on Khether the 60 day relocation time, as eontained in paragraph 7, ie sometning that the City could live with and what the r�anonable chances ere of havin�; to so relocats. 2. Res 12" Sanitary Sew�r Lins: There again we Gall your attentfon ta paragraphs 5 a�d 9 in particular and, as you c�tn see the same problem will arise in regard to the sewer facflity. In that cas�, you at least could r�iocat� it withan the proposerI _ e��eme�nt and you as�a�n �uuld determine what likeli�ood may oceur that would require such relocation especia].ly wh�re the easement is lfmited to 3.5 feet in any event. It seems ta be ar� extremely� tight requiremer�t that Puget is imposing. 3. Re: Slope Easem�nt: You wil.l note that paragraphs 3 and 6 may rwt be ace�ptable. As to the latter, any relocatfon of Gra�ntor�s facilitfes wou�d have to be done a� the Cityts expense. I cannot tell what kind of a slope easement you havs in mind and how vital it is sin�e it seems �to $ffect the southerly 12 feet {. of Puget's property. I certainly am not in a position to advise " on the Iikelihood of such occurrence and t}�is fs a matt�r that �i the Engin�ering Department should deeide: Our function ahould �� be limited to point�ng out the pos�ible legal consequences by � reason of the variou� clauses inEerted in the easement. � • �. � �.
