Box 626 Trenton, T7aihington 98055 DRAINAGE EASESENT THIS INSTRU11ENT, made this a;T of August, r,,.,. 1979, by and between PUBLIC HOSPITAL DISTRICT NO. 1 OF KING COUNTY, a muiicipal corporation (Valley General Hospital), hereinafter called "Grantor"; and the CITY OF P"PNTON, a municipal corporation, hereinafter called Grantee" I TN F S S E T H: ihat said Grantor does by these presents grant unto said Grantee, its successors and assigns, a perpetual easement for drainage purposes, with necessary appurtenances, over, through, across and upon the following described property in King County, Washington, more particularly described as follows: That portion of Section 30 and Section 31, Township23North, Range 5 East, W.M., King County, Washington, lying east of the easterly line of State Road No. 167, described as follows: Beginning at the intersection of the North line of Section 31 with thS easterly lineofsaidStateRoadNo. 167; thence S 10 56'32" W along said easterly line 29.2 feet; thence S 79003'28" E 30.02 feet; thence yv' 10 56'32" E 288.5 feet; thence N 89 03'08" W 30.46 feet; thence S 10 56'32" Tri 253.82 feet to the point of beginning The Grantee, its successors or assigns shall have the right, without prior notice or proceeding at law, at such times as may be necessary to enter upon said above described property for the purpose of installing, maintaining, repairing, altering or reinstalling a drainage facility and appurtenance, or making any connections therewith, without incurring any legal obligation or liabilities therefor, provided that such installation, maintenance, repairing, altering or reinstallation of such drainage facility and appurtenances shall be accomplished in such a manner that the private improvements existing within the property the subject of this, instrument and the Grantee's property adjacent thereto shall not be disturbed or damaged; or in the event they are disturbed or damaged, they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall fully use and enjoy the aforedescribed premises, including the right to retain the right to use the surface of said property the subject of this instrument if such use does not interfere with installation and maintenance of the drainage r- line. However, the Grantor shall not erect buildings or structures over, under or across the property the subject of this instrument. VOW This easement shall be a covenant running with the land and shall be binding upon the Grantor, its successors and assigns. 1W Grantor covenants that it is the lawful owner of a portion of the above described property and the contract purchaser of the remaining portion thereof; and that it has a good and lawful right to execute this Agreement.
