Steven and Tara Holman , hereinafter referred to as "owners," �
hereby covenant and agree to sign the necessary petitions for annexation to the City
Limits of the City of Renton, Washington, for the properry herein described and on j
the terms more fully set forth below.

2. Basis for Covenant This covenant to annex is given as a condition to
� being permitted to hook up to sewer and/or water service from the City of Renton to

� 3. Parties Bound This agreement and the covenant to annex shall be
0 binding on the owner and all persons subsequently acquiring any right, title or
�'°� interest in or to said properry referred to as the premises, and shall be a covenant

running with the land.
4. Time for Performance The owners, their heirs, successors or assigns,

agree and covenant to sign a petition to annex the above-described premises unto the
Ciry of Renton at such time as the assessed valuation of the subject premises is
sufficient to qualify under the 75% method pursuant to RCW 35A.14.120, together
with such other adjoining or contiguous area as the City of other petitioners may
determine. The owners further agree, when so notified by the Ciry, to promptly
circulate and execute such Petition and to comply with all the requirements of law
regarding such annexation. If the owners, their successors or assigns fail to do so, the ,
� City reserves the right to terminate such utility services.
5. Filin These covenants shall be filed with the King County Auditor.

STEVEN RND TARA HOLMAN'S SEWER EXTENSION REQUEST

(
During the Utilities Committee rryeeting of Aprii 15, '!99'!, the request by Mr. & Mrs.
Steven Ha(man, the proponent , to cannect their house to the City's sewer systerrz was
considered. Their house is located at 13&12 SE 136th Street which is outside the City
fimifis. In review of the prapanent's request, the Committee finds the following:
1. Based on the attached memo from the Planning/Building/Public Works Department,
.� a failing septic tank and drain field exist at the proponent's hause;
2. Consisfient with Council policy, sewer cannections may be granted autside the
� City limits if � failing septic tank and drain fiefd exist;
3. As a candition of ai(owing this sewer connection, that the proponent agree to the
t fo(lowing conditions: ,

j a) The Haiman's sign and have executed covenants agreeing nat to protest �
annexation for their parcei; '

I b} The Ha(man's rnake connection ta City s�wer consistent with Gity Cades, ;
� Standards, and Paf'scies; �

� c) The Halman's obtain and pay for a!I required permits, including bufi not '
� limited ta a City Side Sewer Permit and County Right-af-Way Permit; �
d) The Holman's pay the amount of 52,620.81. This amount being equivalent
• to the sum paid by the adjoining City praperties within Heather powns for '
construction af the sanitary sewer mains under LID 279. The Holman's
� '� shall have the option of spreading these charges over a period of ten years
with interest thereon fixed at the rate of 10% per annum; and ,
e) Acknowledge as nan-City residents they are required to pay the utility rate
set by City Council for non-residents tcurrently one and one-haif the
standard rate).
