Dear Jack:
We had heretofore aentfio qou copiee of our lettera to the King Countq
Asaeesor'e off ice and to Pnget Sound Title Insurance C�paaq regarding
the sbave captioned matter, whieh letters were dated October 9 and 19,
1964, reapectively. 3ince that time we have had several neetinga and
discussions with Mr. Bern MeDonald o€ Puget Sound Title Insurance Co�pany
in an attempt to trace the court proceedings in 1909 - 191fl relative to
the City's acquisition of said property. You will reme.daber that qou had
previoualy looked into the matter end determined that there was no evfdence
that the City lud fee� title to the dam aite and that the county aasesaor'a
record showed a privats partp to be paqing taxes on the 2� acre site.
It was extremely difficult for the title company to make a proper search
of the recorda aa manq of theae old files are no longer atored in the
D caurthouse but ia some warehouae facilities. We had heretotore ordered !
from the company a preliminarq report �ince, if the City hud not acquired --�"'
fe�c:: title, some legal ection would have been necesaary to either "�cquire
tit2e•' to the dam aite or briag some related action claiming "cfllor of
title" or a possible "loet deed".
I� has now been determined and we have� copies of the record ahowing that
there was an "adjudicatioA of public use" in case No. 67178 which adjudication
waa aigned .7un� 30, 1909. A jury ther� Srought in the verdict �rar; Mr.
Clarence M. Aus��,in in the sun of $1�500.�0 �or the acqui�itfoa of the dam �fte,
and we also have photostatic eopies of the minute entry by the court dated
3atc�rday, July 10, 1909, eetting forth the descriptian of the property and
the �ury's verdict. We feel that this is quite reliable evidence that the
����� site had been acquired by the City. We $uggest, however, that our
City Clerk search the reeorda to dttersina.whether the City had paid iato
caurt said aun of $1,SOQ.00� or a similar sum, sometime on or after July 10,
1909. Please let us know, aa aoon as poasibl�, what onr City recorda show.
Aesetming that such paqment ha� been made� then � ahould submit eopiea of
the jury verdict and the �ournal entrp to Lhe Countq Aaseeaor's office ao
that praper changes be made in hie records. We presume that you have verif ied
the fact that the dam aite ia not listed as Citq property on the Asaeasor's
records, but atanda in the name of a private party. If that i� so, we
certaiulq shall be glad to eubmit the aforeaaid records to the County
Aaseaeor so that the proper change8 ean be made.

ahell be glad to go over with qou the varioua in�trunenta that we have
hereinabove �entioned.
