Said heretofore mentioned grantee, its successors or assigns , shall have
the ri�t, without prior notice or proceeding at law, at such times as may be
necessary to enter upon said above described property for the purpose of construct-
ing, maintaining, repairing, altering or reconstructing said roadway and utilities,
or making any connections therewith, without incurring any legal obligations or
liability therefore, provided, that such construction, maintaining, repairing,
altering or reconstruction of said roadway and utilities shall be acco�lished in
� such a manner that the private irrprovements existing in the right(s)-of-way shall
not be disturbed or damaged, they will be replaced in as good a conditiqc► as they
rdere irrmediately before the property was entered upon by the Grantee.
� The Grantor shall f�lly use and enjoy the aforedescribed premises, including
t'7 the ri ght to retain the ri ght to use the surface of sai d ri ght-of-way i f �uch use
Q` does not interfere with installation and maintenance of the roadway or utilities .
� However, the grantor shal 1 �ot erect bui 1 dings or structures over. under or across
� the ri ght-of-way duri ng the exi stence of such roadway and uti 1 i ties.
� This easement, shall be a covenant running with the land and shall be bind-
t�- ing on the Grantor. his successors , heirs and assigns . Grantors covenant that they
are the lawful owners of the above properties and that they have a good and lawful
ri ght to execute thi s agreement.
