The Grantor, GLACIER PARK COMPANY, a Minnesota corporation hereinafter called Railway Company, for and in consideration of Three Hundred and No/100 Dollars ($300.00) to it paid, and the agreements herein contained, does hereby grant to � the CITY OF R�NTON, a Municipal corporation, hereinafter called City, an easement �"` � � for public utilities (including water and sewer) through, under and along the C"3 � follo�ving described premises situated in King County, Washington. � A strip of land 45 feet wide within the NW 1/4 of Section 30, Township � 23 N., Range 5 E., W.M. lying parallel with, adjacent to and southerly of the centerline of the new alignment of Strander Blvd., and more particularly described as follows: Beginning at the NW corner of said Section 30, thence S. 89052'02" E. along the north line thereof a distance of 1003.37 feet to the 1/16 line which runs in a north-south direction through the NiV 1/4 of said Section 30, said 1/16 line also being the centerline of Lind Ave. SW; thence S. 1°35'13" t�. along said 1/16 line and the centerline of Lind Ave. SW a distance of 1313.9i feet to the 1/16 line which runs in an east-west direction through the N�V 1/4 of said Section 30, said 1/16 line also being the centerline of SW Strander Blvd.; Thence N. 89°40'25" W, along said 1/16 line and the centerline of SW Strander Blvd. a distance of 40 feet to the true point of beginning; thence continuing N 89°40'25" W. a distance of 515 feet to a point of curvature; thence northwesterly along a curve to the right, having a radius of 2000 feet, through a central angle of 11�50'26" an arc distance of 413.31 feet to a point which lies 20 feet easterly of, as measured at right angles to, the west line of said Section 30; � Thence S. 0°49'ZO" �V. along a line parallel with and 20 feet easterly of said subdivision line a distance of 45.88 feet to a point on a curve; thence northeasterly along a curve to the left, having a radius of 2045 feet, through a central angle of 11035'15" an arc distance of 413.58 feet to a ' point which lies 45 feet southerly of, as measured at right angles to, the east-west 1/16 line within the NW 1/4 of said Section 30, said 1/16 line also being the centerline of Sj9 Strander Blvd. Thence S. 89°40'25" E, along a line parallel with and 45 feet southerly of said subdivision line a distance of 515 feet to a point which lies 40 feet , westerly of as measured at right angles to the aforementioned centerline � of Lind Ave. SW; Thence N. 1°35'13" E, along a line parallel with and 40 feet westerly of I said centerline a distance of 45 feet, to the true point of beginning. This easement is made subject to and upon the following express conditions: I The Railway Company, for itself and its successors and assigns, reserves all rights to use the property hereinbefore described for any and all purposes whatsoever not inconsistent with the easement hereby granted when deemed necessary or expedient to the Railway Company. Rights reserved shall be so exercised as not to damage or interfere with the utility easement as above defined. I � � `` ' ;f''Fil ' ' ' • . � , • ` ' • `� ''i' „ � . - • II This instrument does not grant or convey unto the City any riglits or title to the surface of the soil along the route of said permanent utility ease- ment except for the purpose of laying down, inspecting, restoring and replacing utilities; provided that any such work which shall disturb the surface of the soil shall be subject to the granting of a temporary construction permit granted by the Railway Company. III N The City sha21 protect and save harmless the Railway Company from any Q`� and all claims, demands, loss, damage expense and liability of every kind and � description including personal injury and for any damage to or loss or destruction � of property whatsoever suffered by the Railway Company their heirs, successors and � assigns, or by any persons, firms or corporations, because of the construction � and/or maintenance of said facilities. � IV In the event that said property shall at any time cease to be used for utility purposes, or shall by operation of law or otherwise become vacated or abandoned, the easement herein granted shall immediately cease and terminate without notice or other proceedings on the part of the Railway Company and the City, its successors or assigns, shall immediately reconvey said property to the Railway Company.
