Conxnencing at the intersection of the South line of said Government Lot 5 with the
Westerly line of said railway right-of-wai; thence North 30°55'53" East along said
right-of-way line 435.00 feet to the true point of beginning; thence North 68°44'15"
West 350.00 feet; thence South 21°15'45" West 150.00 feet; thence North 68°44'15"
West 15.00 feet; thence North 21°15'45" �ast 265 feet; thence South 68°44'15" East
� 15.00 feet; thence South 21°15'45" West 100 feet; thence South 68°44'15" East
� 352.56 feet to the Westerly line of said railroad rightrof-way; thence South

Grantor reserves the right to relocate or remove said water lines at
its sole discretion.

Said heretofore mentioned grantee, its successors or assigns, shall
have the right, without prior notice or proceeding at law, at such times as
may be necessary to enter upon said above described property for the purpose
of constructing, maintaining, repairing, altering or reconstructing said
utility, or making any connections therewith, without incurring any legal
�bligations or liability therefore, provided, that such construction, main-
taining, repairing, altering or reconstruction of such utility shall be
accomplished in such a manner that the private improvements existing in the right
right(s)-of-way shall not be dtsturbed _ or damaged, or in the event they are
disturbed or damaged, they will be repTaced in as good a condition as they we re
irranediately before the prnperty was entered upon by the Grantee.
The Grantor shall fully use and enjoy the •aforedescribed premises,
� including the right to re tain the right to use the surface of said right-of-way
� i f such use does not interfere wi th install ation and maintenance of the uti 1 ity
d- line. However, the grantor shall not erect buildings or structures over, under
� or across the right-of-w�y during the existence of such utility.

� This easement, shall be a covenant running with the land and shall be bind-
� ing on the Grantor, his successors , heirs and assigns. Grantors covenant that
they are the lawful owners of the above properties and that they have a good and
lawful right to execute this agreement.
