THIS INDENTURE, Made this � �7�y day of June, 1960,

� between PUGET SOUND POWER & LIGHT COMPANY, a Massachusetts

7�. corporation, herein called "Grantor" , and City of Renton,

�� herein called "Grantee" ,
W I T N E S S E T H :
That in consideration of the sum of One DOLLARS
($1.00) in hand paid, receipt of which is hereby acknowledged,
and the performance by Grantee of the covenants hereinafter
set forth, Grantor hereby grants un,to Grantee, without warranty
of any kind, an easement hereinafter described, for the con-
struction, maintenance and operation of the Windsor Hills
pumping station and appurtenant water mains , including but not
limited to a water main running from the new pump house south-
easterly to the old pump house situated at the southeast corner
of the following described land, all as shown on the attached
Site Plan. prepared by Stevens & Thompson, dated 4-12-60, bear-
ing File No. 116-C-101, being the first of three sheets, and
not otherwise without the prior written consent of Grantor,
within and across the following described land situated in the
County of King, State of Washington, to wit:
Beginning at a point 159,98 feet South and 113. 73 feet East of
the Northwest corner of the Southeast 4 of the SE4 of Section 8,
T23N, R5E, W.M. , said point being on the west right-of-way line
of P.S.H. No. 2 at Station 37+86.9, thence at right angles to ��
said highwa�� South 73°39 ` West 45 .0 feet, thence South 16°21 ' ` �
East 35 .0 feet, thence North 73°39 ' East to the west right- �7'
of-way of said highway, thence northerly along the west right-
of-way to the point of beginning.
This easement is granted on the following terms and
conditions :
� l. Grantee agrees to install and maintain substantial
permanent markers sufficient to give notice to all persons of
the location of Grantee' s buried facilities, including without
limitation mains, electric supply line, telephone lines and drains .

2 . Grantee will use and maintain its facilities on the
' premises so as to be in accordance with all laws, rules and
Qj regulations of the State of Washington, and witn specifications
�
� for overhead crossings of electric power lines, as approved and
?ti.
� specified from time to time by the National electrical Safety
Code and other applicable ordinances and laws .
3 . Grantee agrees to save and hold Grantor harmless from �
all loss or damage which may be due to the exercise by Grantee
of the right herein granted and from all claims for such damage
by whomsoever made and to indemnify Grantor for all such loss,
damage an,d claims .
4. Grantor reserves the right to use said land for its
own purposes in any way, and to grant rig'r.ts in said land to
others, not inconsistent with the right herein granted to Grantee,
and Grantee hereby assumes all risk of loss or damageP including
damage or injury to persons or to property, which may be suf-
fered by Grantee resulting from Grantor' s use of said land and
any of its equipment thereon, wYiether said damage or injury
be due to the negligence of Grantor, its servants or agents,
or otherwise.
5 . If the existence of Gr.antee' s facilitiesshall require
the relocation or modification of any of Grantor' s facilities
on or near thE premises, Grantee agrees to reimburse Grantor for
� the cost of such relocation or modification.
6. The right hereby granted shall cease and determine
whenever Grantee shall have discontinued the use of said facility
for one year and upon such discontinuance Grantee shall remove
its facilities and restore the premises to as good a condition �

� as they were in prior to the construction of said facilities .
_ , 7. Grantee agrees to pay any and all taxes, assessments
and the like assessed against its said facilities and shall re-
� �imburse Grantor for any in�rease in taxes payable by Grantor
