New Lot 1 is proposed to be located behind new Lots 2 and 3 and be suitable for future development. As part of the Lot Line Adjustment, the applicant is proposing a 26-foot easement that would eventually serve new Lot 1. We recommend that the legal description for this document be prepared by a surveyor. It is the applicant's responsibility to ensure this document is properly prepared and recorded with the County. Services memo, dated July 29, 2004. Once the comments are addressed, please submit two sets of an original signed mylar and a check for $15.73 made out to Cb&L to me at the sixth floot counter of City Hall. Please verify that the mylars havebeen signed by all owners of record and have been notarized with an ink stamp (not embossed) .. The ink stamp must be legible so that King County will promptly record the lot line adjustment. This decision to approve the proposed lot line adjustment is subject to a fourteen (14) day appeal period from the date of this letter. Any appeals of the administrative decision must be filed with the City of Renton Hearing Examiner by 5:00 pm, August 16, 2004. Appeals must be filed in writing together with the required $75.00 application fee with: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98055. Since the reconfigured lots are under common ownership at the time of recording, there is no new easement until such time as ownership of the lots is conveyed to others, together with and/or subject to specific easement rights. A note has been added to sheet 1 4. New easement is shown, no others were disclosed by title company. 5. Address has been added in address block on sheet 2. 6. Topographic items have been removed with the exception of encroachments, houses, and edges of asphalt. 7. Examined has been edited. 8. Proper symbol has been added at the location on sheet 2. 9. The 26 foot private easement remains unchanged and a place for it's recording number has been provided on sheet 2. 10. There are no restrictive covenants or agreements. The following changes will be necessary in order for the City to approve your proposal: 1. Revise the common lot line between proposed Lots 2 and 3 so that the existing single-family residence on Lot 3 is a minimum of five feet from the common property boundary. 2. Note the City of Renton land use action number and land record number,LUA-04"068-LLA and LND-30-0280, respectively, on the draWing sheets in the spaces already provided. Please note that the type size used for the land record number should be smaller than that used for the land use action number. 3. Show the City of Renton monuments/ties on the drawing (Sheet 1 of 2), or note by explicit reference to other doCument(s), e.g. CityofRentonSurvey Control Network ties per ROS #20000208900002. The geometry Will be checked when the ties are provided. 4. Note all easements, agreements and covenarits,of record on the drawing, if any. 5. The Development Regulations are available for purchase for $50.00 plus tax, from the Finance Division on the first floor of City Hall or on-line at www.cLrenton.wa.us. , Project Proposal: The subject properties are addressed as 519 and 525 SW 3rd• Place. The site is located on the south side of SW 3rd Place between Earlington Ave. SW and Stevens Ave. SW. The proposal is for a lot line adjustment involving 3 lots. The lots are currently 40' x 246' with frontage on SW 3rd Place. The proposed adjustment would have two 60' x 134' lots fronting SW 3rd• The third lot would be behind these front lots with dimensions of 120'x 112' with 134' private easement. The 0.68 acres site is zoned R-8 and has two existing single-family structures. The two structures will remain on the reconfigured 8040 square foot front lots. The third lot will contain 13,440 square feet with future potential to short plat creating a fourth lot. The 20' wide private easement would serve as a shared private driveway. The applicants have an administrative determination from the Director of Development Services Division dated July 15, 2002 that the reconfiguration of the lots adhere to the intent of a lot line adjustment. ZoninglDensity Requirements: The subject property is located within the Residential - 8 dwelling units per acre (R-8) zoning designation. The required density in the R-8 zone ranges from minimum of 5.0 to a 'maximum of 8 dwelling units per acre (dulac). In order to calculate net density, private access easements serving three or more units, areas to be dedicated to the City, as well as sensitive areas must be deducted from the gross area of the property. There do not appear to be any areas to deduct on the proposed lot line adjustment or future short plat. The proposed lot line adjustment would maintain a density of 4.41 dulac (3 lots total/O.S8 acre = 4.41 dulac), which is below the allowed density range of the R-8 zone. The future short plat creating a fourth lot would have a density of 5.8 dulac (4 lots total/O.S8 = 5.8 dulac), which meets the allowed density range of the R-8 zone. Development Standards: The following development standards apply to the proposed lot line adjustment and short plat: Nobis-Hendry Lot Line Adjustmenl t're-Application Meeting April 22, 2004 Page 2 of3 Minimum Lot Size, Width and Depth -The minimum lot size permitted in the R-8 zone is 4,500 square feet. Lots 6 and 8 are proposed to be approximately 8040 square feet; Lot 7 is proposed to be approximately 13,440 square feet. All the lots meet the minimum lot size requirement. The proposed lots would be considered interior lots. All interior lots must have a minimum lot width of 50 feet and a minimum lot depth of 65 feet. Lots 6 and 8 are proposed to have a width of 60 feet and a depth. of 134 feet; Lot 7 is proposed to have a width of 120 feet and a depth of 112 feet. Both lots meet the minimum lot width and depth requirements . . Building Standards -The R-8 zone allows a maximum building coverage of 35% of the lot area or 2,500 square feet, whichever is greater for lots over 5,000 square feet in size. Building height is restricted to 30 feet and 2-stories. Detached accessory structures must remain below a height of 15 feet and one-story with a gross floor area that is less than the primary structure. Accessory structures are included in lot coverage calculations. The square footage of the footprint of the existing residence was not given. The short plat drawing must label the footprint area of all existing structures on site in order to verify compliance with lot coverage regulations. Setbacks -Setbacks are measured from the property lines to the nearest point of the structure. The required setbacks in the R-8 zone are 20 feet in the front, 20 feet in the rear, and 5 feet on the sides. SW 3rd Place would be considered the front property line for Lots 6and 8. The property line to which the access is gained would be considered the front of Lot 7. Adequate information was not provided regarding the existing residences to determine rear setbacks. Access -As proposed, two reconfigured lots have street frontage. A 20 foot shared driveway and utility easement would be provided for the rear lot. This private easement would comply with requirements to short plat for a future fourth lot, however any further division of the rear lot would require a 26 foot easement. The Fire Department will require the paving of the complete 20 feet width of the shared driveway to meet code requirements. Access roadways are required to be constructed to within 150 feet of the furthest point of construction. \ Parking: Each lot is required to accommodate off street parking for a minimum of two vehicles. As proposed, both lots appear to have adequate area to meet the parking standards. Critical Areas: According to the City of Renton maps, the site contains sensitive (25 to 40%) slopes and is adjacent to a parcel that contains protected (greater than 40%) slopes. Renton Municipal Code requires a geotechnical report for all projects on sites with sensitive and/or protected slopes. A geotechnical report will be required as part of the short plat submittal for this project. Environmental Review: Short plats four lots or less that do not have any critical as defined by the City of Renton's Municipal Code (RMC 4-3-050) are exempt from the Environmental Review process. The Renton Municipal Code does not include sensitive slopes in the definition of critical areas. Environmental (SEPA) review is not required for this project. Permit Requirements: The Lot Line Adjustment is processed within an estimated time frame of 6 to 8 weeks for approval. The application fee is $450.00. The short plat process is estimated within the same time frame to obtain preliminary approval, the application fee is $1000.00, plus first class postage (currently $0.37) for each mailing label required for notification to surrounding property owners within 300 feet of the site. The two-lot frontage on SW 3rd Place would be replaced with three lots, the one in the middle being a 20-foot wide pipestem 134-feet long serving its larger 112' X120' portion on its southern half. The 0.68-acre site is designated Residential Single Family on the Comprehensive Plan Land Use Map and zoned R-8, eight units per net acre. Relevant Comp Plan land use policies are attached. Analysis: The applicants have indicated that they would like to eventually short plat the 112' X 120'portion into two lots for a total of four lots on this 29,520 square foot site. This would be comparable to a density of approximately 5.90 units per net acre. This area, however, is large enough to be short platted into three lots, which would bring the density up to 7.38 units per net acre. There is a real question in staffs minds is whether the proposed lot line adjustment meets the intent of this administrative procedure given the definition of "lot line adjustment." LOT LINE ADJUSTMENT: "A lot line adjustment is the adjusting of common property line(s) or boundaries between adjacent lots, tracts or parcels for the purpose of accommodating a transfer of land, rectifying a disputed property line location, or freeing such a boundary from any difference or discrepancies. The resulting adjustment shall not create any additional lots, tra,cts or parcels and all reconfigured lots, tracts or parcels shall contain sufficient area and; dimension to meet minimum requirements for zoning and building purposes." In terms of the criteria for lot line adjustments set forth in the definition, staff note that none of the mentioned criteria appear to be met. The applicant's haven't stated that any property lines or boundaries are in dispute, nor does the proposed lot line adjustment appear to be for the purpose . of accommodating a transfer of land. Whereas all three of the proposed reconfigured lots exceed the minimum 4,500 square foot lot size in the R-8 Zone, Lot 8 appears to be non-conforming since its width is only 40-feet rather than the required 50-feet minimum. As noted above under the definition of Lot Line Adjustment, Nobis-Hendry Lot Line Adjustment 04/20/2004 2 the "resulting adjustment shall not create any additional lots, tracts or parcels and all reconfigured lots, tracts or parcels shall contain sufficient area and dimension to meet minimum requirements for zoning and building purposes." Also, as noted in Policy LU-70 the use of pipestems should be discouraged for new development. Conclusion: In light of the difficulties this lot line adjustment faces and the increasing scrutiny implementers are receiving regarding the type and quality of new infill housing, we should be avoiding piecemeal development whenever possible. By looking at the eventual disposition of this site, which the applicant has indicated would eventually have a fourth lot there may be the potential for creating five lots or a better configuration that supports a quality development. Such an arrangement would increase the density from five plus units per net acre to 7.35 units per acre rather than five or six units per acre. A better way to achieve higher density and quality infill in, staff s opinion would be through the regular short plat process rather than through a questionable lot line adjustment followed with a short plat later on. Recommendation: Do not support this proposed lot line adjustment. Do, however, support in concept a future four or five lot short plat subject to relevant land use policies and minimum requirements for zoning and building purposes being met. A minimum lot size of 4,500 square feet should be allowed in singlejamily residential neighborhoods except when flexible development standards are used for project review. Policy LU-36. Allow development at 9.7 dwelling units per acre on infill parcels of one acre or less as an incentive to encourage single-family small lot development on 4,500 sq. ft. lots. Policy LU-40. New plats developed at higher densities within existing neighborhoods should be designed to incorporate street locations, lot configurations, ,and building envelopes, which address privacy and quality of life for existing residents. Design and Improvement Standards for Residential Areas Policy LU-70. Streets, sidewalks, pedestrian or bike paths in a neighborhood development should be arranged as an interconnecting network. The extensive or predominant use of cul- de-sacs and pipestems should be discouragedfor new development. A "flexible grid" pattern of streets and pathways should be used to connect adjacent and future development. Policy LU-76. To visually improve the public streetscape and the safety of perimeter sidewalks and facilitate off-street parking, construction of alleys providing rear access to service entries and garages should be encouraged.
