Project Description / Background: The applicants, Marc and Karen Pritchard, are requesting approval of an administrative variance from the required front yard setback in the R-8 zone (section 4-2-110A). The subject site is located at 2807 Mountain View Avenue N. The project site is abutting Lake Washington to the west and Mountain View Avenue N and the Northern Pacific Railroad right-of-way to the east. The site is 13,162 square feet in area, however the majority of the site is covered by water. Approximately 2,205 square feet of land is above the high water line. An additional 25-foot setback from the Ordinary High Water Mark is required under the Shoreline Regulations. As a result, the site has 939 square feet of buildable area. The existing single-family residence is a one-story 440 square foot cottage. The structure currently appears to be non-conforming with regards to front, side and rear setbacks. The existing front setback is approximately 15 feet. This structure is proposed to be removed in order to construct a new single-family residence. The development standards of the R-8 zone require a minimum front yard setback of 20 feet. The setback is measured from the property line to the closest point of the structure. The applicant is proposing a reduction of this setback to zero feet in order to construct a 2,259 square foot (1,975 sq ft with 284 sq ft attached garage) single-family residence within the lot. The actual footprint of the proposed residence is 827 square feet. The variance proposal would meet the required interior five-foot side yard setbacks. In order to comply with the required 25-foot setback from the Ordinary High Water Mark (OHWM) and retain an acceptable buildable area for a new residence the applicant is requesting an Administrative Variance in order to encroach into the front yard setback. Due to the limited depth of the lot, the applicant wishes to place the new structure at a zero front yard setback. The applicant's proposed plans show front porch steps and front roof overhang encroaching into unimproved right-of-way along the front property boundary. The proposal meets all other R-8 development standards including: maximum building height, lot coverage, rear and interior side yard setbacks as well as required 25-foot setback from the OHWM. FINDINGS, CONCLUSIONS & DECISION Having reviewed the written record in the matter, the City now makes and enters the following: D. Findings 1) Request: The applicant, Marc and Karen Pritchard, has requested approval for an administrative variance from the required 20-foot front yard setback in the R-8 zone (section 4-2-110A) for the property located at 2807 Mountain View Avenue N. A zero fobt front yard setback is being requested. 2) Administrative Variance: The applicant's administrative variance submittal materials comply with the requirements necessary to process a variance. The applicant's site plan and other project drawings are entered as Exhibits No. 1 through 5. 3) Existing Land Use: Land uses surrounding the subject site include: North: single- family residential; South: single-family residential; East: Mountain View Avenue Nand the Northern Pacific Railroad right-of-ways; and West: Lake Washington. 4) Zoning: The site is located in the Residential - 8 (R-8) dwelling units per acre zone. The development standards for this zone require a 20-foot front and rear yard setback, 5-foot interior side yard setback, and a 15-foot side yard along a street setback. Maximum lot coverage is 35 percent or 2,500 square feet, which ever is greater. 5) Topography: The topography of the site has a gradual downward slope from the northeast to the southwest of approximately 20%. 6) Lot and Building Size: The site is 13,162 square feet. The land area out of the high water line is approximately 2,205 square feet. The proposed single-family residence totals 2,259 square feet with a footprint of approximately 827 square feet on the first floor. Therefore, building lot coverage for this site is approximately 38%(827/2,205 = 38), which is typical for this neighborhood. . 7) Encroachment: The proposed new single-family structure shows the front porch stairs encroaching over the front property boundary approximately 5 feet. The roof overhang is also encroaching over the front property line into the public right-of-way. The plans are to be revised to remove these encroachments. 8) EXisting Structure: The existing one-story 440 square foot single-family structure is to be removed in order to construct the new two-story 2,259 square foot single-family residence. 9) Consistency With Variance Criteria: Section 4-9-2508.5.a. Specifically, the applicant indicates that the property is constrained by the 25-foot Shoreline Regulation setback from the Ordinary High Water Mark (OHWM) on Lake Washington. The lots in this area along Mountain View Avenue N located in C. D. Hillman's subdivision are partially covered by water. The actual usable land area of the subject lot is 2,205 square feet, or 17% (from the High Water Mark) of the lot 2,205/13,162 = 0.17). b. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: . The applicant contends that. the proposed residence will be consistent with the. neighborhood and will not impede or damage access to adjoining properties. One letter was received from a neighbor voicing concern but not objection to the project and its impact on traffic and pc;lrking. This neighborhood has limited parking and is accessed by 20-foot wide Mountain View Avenue N. Staff does not anticipate the proposal to increase traffic fiow congestion or parking, as it is to remain the same use as currently. The single-family residence will cause no increase of required parking and has an attached one-car garage. The estimated value of the proposed residence will be $159,000 to $200,000. The applicant is aware no encroachments will be permitted into the right-of-way and will have the plans revised prior to application of building permit. Therefore, the granting of the variance would not be materially detrimental to the public welfare. Staff anticipates the proposed new single-family residence would enhance the site by replacing a one-story cottage valued at $8,000. c. That the approval as determined by the Zoning Administrator is a minimum variance that will accomplish the desired purpose: The applicant contends that the request is a minimum variance needed in order to construct a new single-family residence, which would emulate other existing homes constructed within the same development. The proposed house dimensions are 29'6" wide by 27'6" deep. By locating the single-family residence at the front property line, with zero setback, a modest structure would be allowed with a one- car garage and meet the 25-foot rear setback to the Ordinary High Water Mark. Therefore, the variance request is the minimum necessary, as determined by the applicant and City staff. E. Conclusions 1. The subject site is located at 2807 Mountain view Avenue N, within the Residential - .8 Dwelling Units per Acre (R-8) zoning designation. 2. The R-8 zone requires a minimum 20-foot front yard setback from the property boundary (section 4-2-11 OA). The applicant is proposing a 20-foot reduction of this requirement to zero feet. 3. The analysis of the proposal according to variance criteria is found in the body of the Staff Report. 4. One letter was received which voiced concern that the approval of the variance will further worsen the traffi~ and parking conditions in the area. The letter did not state objection to the request. . Dear Ms. Weil, We are writing this letter to express our concerns regarding the requested front yard setback variance at 2807 Mountain View Ave N. We have two basic concerns about the reduction in the required front yard setback at this location. Our first concern is safety of auto traffic and pedestrian traffic on Mt View Ave. We are concerned that limited sight distance at the site and the closeness of the garage entrance to Mt. View Ave. will create a safety hazard for both cars and pedestrians exiting the residence and cars and pedestrians on Mt. View Ave. Our second concern is the lack of onsite parking when the structure is placed so close to the street. Parking on Mt. View Ave. is generally in short supply. Without a driveway to accommodate additional vehicle parking it is likely that all visitors to the residence will be forced to park throughout the neighborhood. These additional parked vehicles could impact access to the driveways of neighboring properties and will definitely reduce the overflow parking available for the preexisting residences. We are concerned that granting this variance will further worsen the already difficult parking situation in our area of Mountain View Ave. and create a hardship for the neighboring properties. We ask that the City of Renton assess and address both of these concerns before approving any variances or issuing building permits for this property.
