All new plantings are Buxus Microphylla Var. Japonica 'Julia-Jane' or, simply Julia-Jane Boxwoods. A total of seven, 2 on the NE corner, 2 on the 7th ave side, 2 on the SE corner and 1 on the south side. I have attached several photos, both detail and full view, please let me know if you require any further photos or if you would like them at print resolution. The purpose of this letter is to strongly protest the 6ft high fence that has recently been constructed on the corner ofNE 6th Place and Dayton Ave. The reason for this letter of protest is because the fence causes a tremendous safety hazard. The fence has made a blind corner. Since the construction of this fence, I have witnessed approximately 3 near accidents. My daughter has almost got hit on this comer because of this fence. There are several small children that play in this area on their bikes and cars coming around this blind corner could be hit. A 3ft high fence would be adequate and eliminate the dangerous bl~d comer situation. I would sincerely request this problem be solved before a terrible accident happens. I spoke to Mr. Paul Baker and he referred me to you for comments on the pending application for the fence. When this problem is resolved, please send me a written copy of it. Thank you very much. The fence was previously installed without a permit, adjacent to NE 6th Place (front yard), Dayton Ave. NE (side yard), and a rear alley (Exhibit 1). The location and height of fences must not obstruct views of oncoming traffic, or views from driveways. Per RMC 4-2-110A, structures over 42 inches in height cannot intrude into the 20-foot "clear vision area". RMC 4-11-030 defines the clear vision area as that area bounded by the street property lines of corner lots, and a line joining points along those street lines, 20 feet from their point of intersection. It appears that the southeast corner of the existing fence at the intersection of NE 6th Place and Dayton Ave. NE, and the northeast corner of the fence at the intersection of Dayton Ave. NE and the rear alley, may intrude into the required clear vision area. Exhibit 4 is the graphical illustration of clear vision area measurement as provided in RMC 4-11-010. In order to retain the existing 72-inch high fence, the applicant must increase the fence corner setbacks to comply with the above requirements. For areas outside of the clear vision area, the fence must be set back at least 3 feet from the road or alley. All setback areas must be permanently landscaped and maintained with appropriate landscaping materials, with the exception of the rear alley. Landscaping in the clear vision area must be less than 3 feet in height, or (for trees) more than 10 feet in height. Additionally, the fence may require relocation and/or further administrative review if street improvements, such as sidewalks, are constructed in future. Prior to the receipt of this letter I was unaware this was necessary; I had used fences in the surrounding neighborhoods as a basis for the design and constrv.ction. It is my desire to come to some amicable solution where I can be permitted for the fence. The fence was built where the previous chain link fence existed. In some cases a few inches further back off the street. The fence was built for privacy and aesthetics and to insure that our dog cannot jump over and is kept safe from speeding traffic. The following are measures applicable to my situation that are listed on the application as permit justifications: • The fencing is all of high quality materials, stained cedar fencing and pressure treated posts and rails to insure that the fence maintains its integrity, visual and structural. e The fence is built with similar design and materials as other fences in the surrounding neighborhood: there are several similar cedar fences with the same types of placements relative to the surrounding streets, design and implementations • The streets surrounding our house do not have sidewalks, however there is more than enough space between the fence and the street to accommodate future sidewalks with room to spare (based on surrounding streets that do have sidewalks) • There are ornamental post caps and additional decorative construction treatments with the recessing of the fencing • The orientation of the finished face of the fence is toward the street on every side of the property, all rails face the inside of the yard. • There are other comparable construction and design methods utilized in the neighborhood. My preference is to work with the City to get into compliance, preferably through permitting what exists. If necessary I hope someone at the city can afford me some direction as to the simplest most cost effective ways to be permitted. I have invested significant time and resources and apologize for simply basing my design and construction on what I observed in the surrounding areas. This is my first experience with this process.
