The fence was previously installed without a permit, adjacent to Kirkland Ave. NE (front yard) and NE ih Street (side yard). (Exhibit 1) The location and height of fences must not obstruct views of oncoming traffic, or views from driveways. Per RMC 4-2-110A, structures over 42 inches in height cannot intrude into the 20-foot "clear vision area". RMC 4-11-030 defines the clear vision area as that area bounded by the street property lines of corner lots, and a line joining points along those street lines, 20 feet from their point of intersection. Based on the graphical information provided by the applicant, it appears that the southwest corner of the fence, at the intersection of Kirkland Ave. NE and NE ih Street, may intrude into the required clear vision area. Exhibit 2 is the graphical illustration of clear vision area measurement as provided in RMC 4-11-010. In order to retain the existing 72-inch high fence, if any portion of the fence is within the clear vision area the applicant must increase the fence setbacks to comply with the above requirements. For areas outside of the clear vision area, fences must be set back at least 3 feet from the sidewalk. All setback areas must be permanently landscaped and maintained with appropriate landscaping materials. Landscaping in the clear vision area must be less than 3 feet in height, or (for trees) more than 10 feet in height. For fence section~ greater than 48 inches high, all setback areas shall be permanently landscaped and maintained with appropriate landscaping materials such as flowers and other plantings, trees, grass, beauty bark and landscaping gravel, etc., with the exception of the rear alley area. We wouldn't have put the fence up above city requirements had we have known about this new requirement. The reason we put our fence up is because the city took down. our hedges that we use to have exactly where the fence is located now to put in the sidewalk located on 7th avenue. Our hedges were 8·10ft high and worked as a fence whereas then our house was not expose to the public. When the city took down (removed all) those hedges, is when this whole process started. We were told that the hedges were going to be cut back so that the contractor could put in the sidewalk. Instead they took away all the hedges that left our house and yard exposed to the public. When the sidewalk was complete our nightmare began, people started walking across our yard, breaking into our storage shed, tampering our back door lock, and coming into our yard stealing anything of value. This is all happening simply because there was access off the streets into our yard, being that our yard is again located on the street. So without a 6ft fence our house is a major target for crime. The fence does not obstruct any vision of traffic. There is a 44ft of clear vision area from the end of the fence to the stop sign. This fence is so important for the safety of our home. A 4ft fence would only make our house inviting to criminals, trash & garbage, and curious children. This fence serves jn an aesthetically pleasing manner, it does not present hazard to vehicular or pedestrian traffic, and is located outside the right of way on private property.
