Please submit two sets of an original signed mylar and a check for $15.73 made out to CD&L to me at.the sixth floor counter of City Hall. Please verify that the mylars have been signed by all owners of record and have been notarized with an ink stamp (not embossed), The ink stamp must be legible so that King County will promptly record the lot line adjustment. This decision to approve the proposed lot line adjustment is subjectto a fourteen (14) . day appeal period from the date of this letter. Any appeals of the administrative decision must be filed with the City of Renton Hearing Examiner by 5:00 pm, May 5, 2005 .. Appeals must be filedin writing together with the required $75.00 application fee with: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98055. Fesser % Maureen Highlands Div. 3 Lot Line Adjustment, LUA·05·028·LLA Format and Legal Description Review Bob Mac Onie and I have reviewed the above referenced lot line adjustment submittal and have the following comments: Comments for the Applicant: In our last review memo, dated March 28, 2005, it was requested that a reference to the Supplemental Declaration of Maureen Highlands document be made on the lot line adjustment, if it affected the subject subdivision. Also, it was requested that the recording number of said supplemental document be noted on the lot line adjustment, if applicable. There does not seem to be any reference to this item in the memo from Core Design dated April 6, 2005. Was said item not addressed, or did it not apply to the lot line adjustment? The recording number noted within the legal description for "PARCEL A" (Sheet I of 2) contains an extra digit. Review and revise as needed. The first line of Item No. I under the "RESTRICTIONS" block contains a typo error ("TOFACILITY"). Comments for the Project Manager: Although the Deed of Dedication document was submitted with this lot line adjustment, the dedication document should be considered a separate action and should not be recorded with the lot line adjustment. Said dedication is not currently referenced on the lot line adjustment submittal and therefore, should be recorded after the lot line adjustment. Note the City of Renton land use action number and land record number, LUA-05-028-LLA and LND-30-0289, respectively, on the drawing sheets in the spaces already provided. Make the abbreviation "NO." (number), as noted in the legal description for "Parcel B" on Sheet I of 2, one item, not split between two sentences. Indicate on the "DETAIL"(Sheet 2 of 2) what has been, or is to be set, at the new corner established by this lot line adjustment. Currently, it is difficult to see, due to the scale of the lot line adjustment drawing (I "=200'). Note encroachments, if any. Note that if there are easements, restrictive covenants or agreements to others (City of Renton, etc.) as part of this subdivision, they can be recorded concurrently with the lot line adjustment. The lot line adjustment submittal and the associated document(s) are to be given to the Project Manager as a package. The lot line adjustment will be recorded first (by King County). The recording number(s) for the associated document(s) are to be referenced on the lot line adjustment. Proof of Loss or Damage. In addition to and after the notices required under Section 2 of these Conditions and Stipulations have been provided to tl1e Company, a proof of loss or damage signed and sworn to by the Assured shall be fumlshed to the Company within ninety (90) days after the Assured shall ascertain the facts giving rise to the loss or damage. The proof of loss or damage shall describe tI1e matters covered by this Guarantee which constitute the basis of loss or damage and shall state, to the extent possible, the basis of calculating the amount of the loss or damage. If the Company is prejudiced by the failure of the Assured to provide the required proof of 1055 or damage, the Company's obligation to such Assured under the Guarantee shall tennlnate. In addition, the Assured may reasonably be required to submit to examination under oath by any authorized representative of the Company and shall produce for examination, Inspection and copying, at such reasonable times and places as may be designated by any authorized representative of the Company, all records, books, ledgers, checks, correspondence and memoranda, whether bearing a date before or after Date of Guarantee, which reasonably pertain to the loss or damage. The Company sha!! have the option to payor settle or compromise for or in the name of the Assured any claim which could result in loss to the Assured within the coverage of this Guarantee, or to pay the full amount of this Guarantee or, If this Guarantee is issued for the benefit of a holder of a mortgage or a lienholder, the Company shall have the option to purchase the indebtedness secured by said mortgage or said lien for the amount owing thereon, together with any costs, reasonable attomeys' fees and expenses incurred by the Assured claimant which were authorized by the Company up to the time of purchase. Determination and Extent ot Liability. This Guarantee is a contract of Indemnity against actual monetary loss or damage sustained or incurred by the Assured claimant who has suffered loss or damage by reason of reliance upon the assurances set forth In this Guarantee and only to the extent herein deso1bed, and subject to the Exduslons From Coverage of This Guarantee. Limitation of Liability. Reduction of Liability or Termination of Uability. All payments under this Guarantee, except payments made for costs, attomeys' fees and expenses pursuant to Paragraph 4 shall reduce the amount of liability pro tanto. 10. Payment of Loss. (a) No payment shall be made without producing this Guarantee for endorsement of the payment unless the Guarantee has been lost or destroyed, in which case proof of loss or destruction shall be furnished to the satisfaction of the Company. (b) When liability and the extent of loss or damage has been definitely fixed in accordance with these Conditions and Stipulations, the loss or damage shall be payable within thirty (30) days thereafter. 11. Subrogation Upon Payment or Setttement. Whenever the Company shall have settled and paid a claim under this Guarantee, all right of subrogation shall vest in the Company unaffected by any act of the Assured daimant. The Company shall be subrogated to and be entitled to all rights and remedies which the Assured would have had against any person or property in respect to the claim had this Guarantee not been Issued. If requested by the Company, the Assured shall transfer to the Company all rights and remedies against any person or property necessary in order to perfect this right of subrogation. The Assured shall permit the Company to sue, compromise or settle in the name of tne Assured and to use the name of the Assured In any transaction or litigation involving these rights or remedies. Arbitration. Unless prohibited by applicable law, either the Company or the Assured may demand arbitration pursuant to the Trtle Insurance Arbitration Rules of the American Arbitration AssocIation.
