WA 98059 Subject: Special Fence Permit -LUA-05-037, SF Dear Mr. Diaz: Thank you for meeting with me yesterday regarding the special fence permit that was issued for your property on October 13, 2005. During our discussion, you requested that staff reconsider the method of measurement for the "clear vision area" as provided in the , . permit conditions. You noted that the graphical examples in RMC 4-11-010 show streets that have straight angles at intersections, but because SE 2nd Street curves around your property without a signed intersection, the "clear vision area" might intrude less onto your property as a result. Transportation planning staff conducted an on-site visit of your property on October 28, 2005, and have determined that the permit conditions for the "clear vision area", are appropriate. This determination is based on both the current configuration of the streets abutting your property, and also the potential for intersection revisions that may occur with development of the proposed Highlands Park subdivision (LUA-05-124) to the east of your property. The application for this proposed ,73-unit single-family residential development, which is currently under Department review, proposes to locate a primary access at the intersection of Rosario Ave. SE and SE 2nd Street. If this access is approved, reconstruction of the current intersection may be necessary to accommodate the new traffic pattern and signage requirements. Therefore, the permit conditions for removal of the fence from the 20-foot "clear vision" area will still apply to your property. I hope this information is useful to you. The fence was previously installed without a perrnit, approximately 1.5 feet from the side yard property line along the sidewalk of SE 2nd Street, and along the rear yard property line approxirnately 9 feet from the sidewalk, as shown on Exhibit 1. The location and height of fences must not obstruct views of oncoming traffic, or views from driveways. Per RMC 4-2-11 OA, structures over 42 inches in height cannot intrude into the 20-foot "clear vision area". RMC 4-11-030 defines the clear vision area as that area bounded by the street property lines of corner lots, and a line joining points along those street lines, 20 feet from their point of intersection. Exhibit 2, Figure 3 is the graphical illustration of clear vision area measurement for this lot as provided in RMC 4-11-010. The northeast corner of the existing fence appears to intrude into the required clear vision area. In order to retain a fence greater than 48 inches in height within the rear and side yards, the applicant must increase the fence corner setbacks to comply with the above requirements. For areas outside of the clear vision area, the fence must be set back at least 3 feet from the sidewalk. All setback areas must be permanently landscaped and maintained with appropriate landscaping materials. Landscaping in the clear vision area must be less than 3 feet in height, or (for trees) more than 10 feet in height. My main reason and justification of a fence of 6-feet is to keep my family safe and private. I consider important to keep my family who is composed of a 3 year old child, and a 6 year old child protected. In addition to this, my residence is located in front of an empty lot where there are many wild animals and different kinds of species that might be harmful for my children. At night time, it gets really risky because there are no lights to control traffic, so any person might break into my house and put my family in danger. I donO t feel secure having my children in the backyard with a 4-feet fence, even during the day because any person might break in. I already installed the 6-feet fence because I noticed that all of the houses in the neighborhood have the same height in their fences. Enclosed are some pictures that 10 ve taken of some surrounding houses with same height fences in my neighborhood. Also, some of this residencies are in the clear vision area and are located abutting the street. Please allow my fence to be 6-feet. As a resident of this neighborhood we have home owners association, which maintains the landscaping from the sidewalks to the fence line. In regards of the quality of my fence, I must say is cedar. I am willing to relocate my fence for the clear vision area if it is necessary, but please allow me to have a 6-feet fence for my family security.
