The applicant is requesting to move the tree within the river channel to reduce the public safety hazard, while allowing the tree to· remain in the river. Heavy equipment is needed to move the tree, including a rubber-tired backhoe, skidder or truck, and cable attached to the tree. The applicant proposes to rotate the tree to the south side of the Cedar River, near the left bank shore, so that it does not span the river and block passage. Equipment will perform the work from an area above the ordinary high water mark. Some of the tree top and branches that extended beyond the ordinary high water mark were removed from the private property located on the right bank (north side) of the Cedar River. The property where work will performed is the Cedar River and City owned property on the left bank (south side) of the Cedar River. The property is currently used as open space and includes the Cedar River Trail. There are existing single-family residences located on the right bank (north side) of the Cedar River. Describe the proposed work that needs aquatic permits: Complete plans and specifications should be provided for all work waterward of the ordinary high water mark or line, including types of equipment to be used. If applying for a shoreline permit, describe all work within and beyond 200 feet of the ordinary high water mark. If you have provided attached materials to describe your project, you still must summarize the proposed work here. Attach a separate sheet if additional space is needed. The project consists of re-positioning a large Cottonwood tree within the Cedar River that has fallen completely across the Cedar River (see attached picture and plans). Due to the Cottonwood tree extending completely across the Cedar River, it presents public safety hazard for boaters, swimmers and other recreational users of the River. The work will include the use of a rubber tired back hole, skidder or truck, along with the use of a cable that will be connected to the top end of the tree. The top of the Cottonwood tree will be pulled or winched towards the left bank (south side) of the Cedar River. The tree will be rotated to the south side of the Cedar River so that it does not extend across the Cedar River and pose a safety hazard to recreational users. The Cottonwood tree will remain in the river near the left bank shore or slightly off shore. The only work in the water will consist of attaching the cable to the tree and the movement of the tree. If necessary for the re-positioning of the tree, tree branches that are dug into the riverbed may have to be cut with a chainsaw. If needed, this would be done by using a new bar and chain on the chainsaw with vegetable oil used as chain lubricant. This may be needed to avoid disturbing the riverbed when the tree is moved. All equipment will be operated outside of the ordinary high water mark. The WDFW Area Habitat Biologist (Larry Fisher) is requiring the City to provide mitigation for the impacts associated with re-positioning the tree within the Cedar River. The mitigation will consist of placing 10 Douglas Fir or Cedar trees that are 6-15 feet in length along with their root wads into an existing constructed side channel located at approximately River Mile 3.3 of the Cedar River, just downstream of the Seattle Public Utilities, King County Metro and City of Renton Utility Crossing of the Cedar River. The existing side channel was constructed as mitigation for the King County Metro and City of Renton Water Utility -Cedar River Utility Crossing Project in 1998. The placement of the trees in the constructed side channel is intended to improve the rearing and refuge habitat in the constructed side channel for Coho and Chinook salmon. The trees will be placed in the channel by hand. PREPARATION OF DRAWINGS: See sample drawings and guidance for completing the drawings. ONE SET OF ORIGINAL OR GOOD QUALITY REPRODUCIBLE DRAWINGS MUST BE A TTACHED. NOTE: Applicants are encouraged to submit photographs of the project site, but these 00 NOT SUbstitute for drawings. THE CORPS OF ENGINEERS AND COAST GUARD REQUIRE DRAWINGS ON 8-112 X 11 INCH SHEETS. LARGER DRAWINGS MAY BE REQUIRED BY OTHER AGENCIES. 7b. Describe the purpose of the proposed work and why you want or need to perform it at the site. Please explain any specific needs that have influenced the design. The purpose of the work is to reduce the public safety hazard to boaters and other recreational users of the Cedar River that the tree presents, since it extends completely across the Cedar River. Boaters and other recreational users may not be able to exit the river in time to walk around the tree. Boaters and other recreational users of the River could be pinned under the tree, which would result in a life safety event. The work needs to be performed prior to the start of the normal fisheries in-water construction window (June 15th), due to the fact as the weather warms up, recreational use increase. The public has expressed the need to take action to prevent someone from being injured. Every effort has been made to reduce the public safety hazard while still maintaining the habitat value that the tree provide, which is why the tree will remain in the river after it is re-positioned to not extend completely across the Cedar River. Every effort will be made to 2 minimize any disturbance of the l'~~ of the river. Describe the potential impacts to characteristic uses of the water body. These uses may include fish and aquatic life, water quality, water supply, recreation and aesthetics. Identify proposed actions to avoid, minimize, and mitigate detrimental impacts and provide proper protection of fish and aquatic life. Identify which guidance documents you have used. Attach a separate sheet if additional space is needed. If the tree is not re-positioned within the River, it will present a public safety hazard and the recreational beneficial uses of the Cedar River will be impacted. The use by fish and aquatic life will not be decreased by the work, since the tree will be left in the River. To minimize impacts, the tree will only be moved enough to reduce the public safety hazard. In addition mitigation will be provided in the City of Renton constructed side channel as described in 7a above. 7d. A tree has fallen across the Cedar River from City of Renton property onto the Larue Property, located at 2505 Maple Valley Hwy., at approximately River Mile 2.5. The tree poses a public safety hazard to boaters and other recreational users of the river, due to the tree being completely across it (see attached plans and photographs). In response to the public safety concerns raised by the Council, the Mayor's office, and the property owner, the Surface Water Utility and the Maintenance Services Division are working to obtain the required permits to allow the tree to be moved within the river channel to reduce the public safety hazard, while leaving the tree in the flver. The work will include the use of a rubber-tired backhoe, skidder, or truck, along with the use of a cable that will be connected to the top end of the tree. The top of the tree will be pulled or winched toward the left bank (south side) of the Cedar River. The tree will be rotated to the south side of the Cedar River so that it does not extend across the Cedar River and pose a safety hazard to recreational users. The tree will remain in the river near the left bank shore, or slightly offshore, as required by WDFW. The only in-water work will consist of attaching the cable to the tree and the movement of the tree. All equipment will be operated outside of the ordinary high-water mark. The WDFW Area Habitat Biologist (Larry Fisher) is requiring the City to provide mitigation for the relocation of the tree within the Cedar River. The mitigation will consist of placing 10 Douglas fir or cedar trees that are 6-15 feet in height, along with their root wads, into a constructed side channel located at approximately River Mile 3.3 of the Cedar River. The mitigation site isjust downstream of the Seattle Public Utilities Water Pipeline, King County Metro Sewer, and City of Renton Water Utility crossing of the Cedar River. The mitigation is intended to improve the rearing and refuge habitat in the constructed side channel for coho and Chinook salmon. The Surface Water Utility requests that the Development Services Division review the City Code to determine if this project qualifies for exemption or not. Jfthe work is not exempt from SEPA and Shoreline, please define the City permit and application requirements that are necessary to allow the relocation of the tree in the river, and the required mitigation. , - .l .;" .< , .' pitts/Tree Crossing ,(if arch 24, 2005 Page2of2 The Surface Water Utility considers the project to be eligible for SEPA exemption due to the following reasons: • The project is necessary to remove a public safety hazard, and qualifies for an emergency exemption. • The project qualifies as a Natural Resource Management Exemption (WAC 197-11-900 (24)), since the work will include relocating a tree in the river. • The relocation ofthe tree in the river is routine maintenance and the action will not have any adverse environmental impacts and, therefore, should be exempt from SEPA. The Surface Water Utility considers the project to be eligible for exemption from Shoreline Regulations due to the following reasons: • The cost of the work will be less than $2,500, and, therefore, qualifies for the Shoreline Regulations permit exemption based upon cost. • The project could be considered a habitat enhancement project since the tree will be repositioned in the river. Trees placed in the City of Renton Water Utility's constructed side channel are also habitat enhancement. The Shoreline Regulations grant an exemption for habitat restoration or enhancement projects. • The project could qualify for the normal maintenance or repair exemption in the Shoreline Regulations. • If necessary, the work could be considered emergency construction since the tree presents a public safety hazard. I am available to meet with you and your staff to review the proposed project, and provide you with any additional information that you may need, to help make the determination regarding the exemption from SEPA and Shoreline Regulations.
