The site is at the northern terminus of Lind Avenue SW and north of the site is the Burlington Northern Railroad right-of-way. The site is zoned Medium Industrial OM) and listed as Employment Area -Valley on the Comprehensive Plan Land Use Map. The applicant is proposing to operate the Joyful Life Church within a 1,982 square foot office space located within an existing two-story 67,260 square foot multi-tenant office building. The current congregation size is approximately 50 members and proposes to have two services on Sunday at 10:30 am and 6:00 pm. The site is consistent with the comprehensive land use policies governing the location of religious facilities. A IS-foot front yard setback is required. The rear yard does abut a multi-residential property, therefore a 50-foot setback is required. The existing structure does comply with all of the setback requirements. There are no other churches in the vicinity and this church would not result in an over-concentration of churches in that area. The location is suitable due to the fact that the hours of use will be different from the hours of use of the other tenants in the building. The Joyful Life Church is proposing to utilize the 315 parking spaces that are already provided on site and appear to be adequate for this use. The existing office space is currently classified as a B-Occupancy according to the building codes and the applicant proposed to keep the B-Occupancy as no more than 50 people are expected on the site at one time. The City's Building Official has determined that since the capacity of the 1,982 square foot office space can hold more than 50 people, the Joyful Life Church shall convert the existing office space from B-Occupancy to A-3 Occupancy prior to operating church services. Royce A. Berg, LPN Architects & Planners, 3003 80th Avenue SE, Mercer Island, WA 98040 stated that they had a young congregation that was small and growing. This space seems to fit the church's needs very conveniently due to location, access and parking. In the old code, the change from B-Occupancy to A-3 Occupancy would not require any construction changes, it may require a couple of swings on the doors in order to change the direction. In the new code there may be required a one hour separation between the two occupancies. Kayren Kittrick, Development Services Division stated that she had no comments on this project. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9: 16 a.m. FINDINGS, CONCLUSIONS & RECOMMENDATION Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Royce Berg for LPN Architects, representing Joyful Life Church, filed a request for a Conditional Use permit to establish a church in an existing building. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit # I. The Environmental Review Committee (ERC), the City's responsible official determined that the proposal was exempt from SEPA review. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There was no opposition from the public regarding the subject proposal. 6. The subject site is located at 500 Southwest 7th Street. The subject is located west of Hardie Avenue SW and east of Lind Avenue SW. A railroad runs along the north boundary of the subject site. 7. The map element ofthe Comprehensive Plan designates the area in which the subject site is located as suitable for the development of Employment Area uses, that is job-creating businesses in a high density environment, but does not mandate such development without consideration of other policies of the Plan. 8. The subject site is currently zoned 1M (Medium Industrial). 9. The subject site was annexed to the City in a series of actions ending with the adoption of Ordinance 4040 enacted in January 1987. 10. The subject site is approximately 3.1 acres. The rectangular lot contains an existing 67,260 square foot two-story, "L-shaped" office building. II. The existing building houses multi-tenant offices. 12. The subject site is level. 13. The applicant proposes establishing a church in a portion of the existing building. The space occupied by the church would be approximately I ,982 square feet. It would be on the first floor and to the rear or north of the building. 14. No external changes or expansion would occur with the establishment of the church. 15. The applicant applied for the Conditional Use permit needed to establish a church at this location. 16. The church estimates that approximately 25 members attend each service and that there is a potential for 50 new members. That is an overall total of approximately 150 church members who would take part in services. 17. Access to the site is provided from SW 7th, an arterial. 18. The use requires 1 parking stall for each 5 seats or 15 stalls for up to 75 worshippers. The parking lot contains 3 J 5 stalls. Code requires fewer stalls for churches than it does for office so that conversion of office space to church use would reduce the parking demand. 19. The church would use the on-site parking lot. Services would occur on Sunday, outside of normal business hours, therefore, lessening conflicts over parking. 20. Utility infrastructure will be unchanged by the new use. The subject site contains existing landscaping as part of the current development. 22. Places of assembly require different fire code and building code construction ratings. Staff suggested appropriate conditions to make sure those ratings are achieved. CONCLUSIONS: 1. The applicant for a Conditional Use Permit must demonstrate that the use is in the public interest, will not impair the health, safety or welfare of the general public and is in compliance with the criteria found in Section 4-9-030.G which provides in part that: a. The proposal generally conforms to the Comprehensive Plan; b. There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent uses, if any; e. Parking, unless otherwise permitted, will not occur in the required yards; f. Traffic and pedestrian circulation will be safe and adequate for the proposed project; g. Noise, light and glare will not cause an adverse affect on neighboring property; h. Landscaping shall be sufficient to buffer the use from rights-of-way and neighboring property where appropriate; and J. Adequate public services are available to serve the proposal. The requested conditional use appears justified and should be approved. 2. The Comprehensive Plan designates this site for employment generating uses and while the church will not result in much additional employment, churches fall within the types of uses permitted in various zones to accommodate religious practices. The space converted for the church is only approximately 2,000 square feet of a 67,000 square foot bui Iding resulting in a minimal loss of commercial space. This, a conversion of office space in an industrial zone, is at this time, a unique proposal. Clearly, it avoids some ofthe problems with parking and noise associated with churches in residential enclaves. 3. This office generally avoids making determinations about community need when reviewing religious institutions. It is probably an inappropriate criteria given the variety of religious denominaticJls that exist. There are other criteria that can be used to determine if the use is appropriate or intrl(sive, this one seems inappropriate for governmental review. 4. The conversion of only 2,000 square feet of an office building to a proposed church does not appear to have any unreasonable impacts on adjacent properties. The church will need parking on weekends avoiding conflicts with commercial tenants. It will be in an existing building with little if any visual presence. This two-story office building is currently constructed and the change in use to a church makes it no less compatible than it was. Its setbacks are pre-existing conditions and apparently created no problems in the past. 6. The parking for up to 315 vehicles is more than adequate for a congregation of approximately 75 parishioners. There are apparently no existing circulation or traffic issues. Southwest 7th can handle this use and alierial access is generally preferred for any type of place of public assembly. 7. There should not be any adverse noise, light or glare problems. 8. In conclusion, the proposed use appears to be a reasonable use. DECISION: The Conditional Use Permit is approved subject to the following condition: I. The applicant shall be required to apply for and obtain an Occupancy Permit from the City of Renton Building Department to change the occupancy of the 1,982 square foot office space from a B-Occupancy to an A-3 Occupancy prior to commencing operation. The Joyful Life Church has existing administrative offices in the office space to the west of the proposed church location. No improvements are proposed to the subject site with the exception of some cosmetic changes that would occur in the office space the Joyful Life Church proposes to occupy. The current building footprint of the structure is approximately 32,917 square feet, which equates to a building lot coverage of 24.3% (building footprint of 32,917 square feet I lot size of 135,285 square feet = 24.3%). The site fronts on SW ]'h Street, which abuts the southern property line of the subject site. The Burlington Northern Railroad right-of-way abuts the northern property line, commercially zoned properties abut the site along the eastern property lines, and industrially zoned properties abut the site along the western property line. The church proposes to utilize the existing onsite parking lot for the parking required for a church use. The church services would be conducted outside of normal office business hours thereby reducing the impact the church would have on other businesses within the office building with regards to parking demand. 2. (a) Comprehensive Plan Land Use Element The subject site is designated Employment Area -Valley (EA-V) on the City's Comprehensive Plan Land Use Map. The purpose of the Employment Area -Valley (EA-V) designation is to allow the gradual transition of the Valley from traditional industrial and warehousing uses to more intensive retail service and office activities. The intents is to allow these new activities without making industrial uses non-conforming and without restricting the ability of existing businesses to expand. The following Comprehensive Plan Land Use policies are applicable to the proposal: Objective LU-X: Site religious and ancillary facilities in a manner that provides convenient transportation access and minimized their adverse impacts on adjacent land uses. The proposed church would be accessed directly off of SW ih Street, a public right-of- way. The submitted materials indicate that church services would be held on Sunday from 10:30 am to 12:30 pm and 6:00 pm to 8:00 pm, which minimizes the impacts of the church on adjacent businesses operating during typical office business hours. Policy LU-1 05. Parking should be provided on-site and buffered from adjacent uses. The proposed church would utilized the existing 315 parking spaces located on-site during church services. Policy LU-32S. Encourage shared parking to use urban land efficiency. The proposed church would utilize the existing on-site parking, which is shared between all of the businesses located within the 2-story multi-tenant office building. The proposed church services would be held on Sundays, outside of normal business hours thereby lessening the impact of congregation members competing with other patrons of the office building for parking spaces. (b) Zoning Code The proposed church use is located within the Medium Industrial (1M) zoning designation. The purpose of the Medium Industrial Zone (1M) is to provide areas for medium-intensity industrial activities involving manufacturing, processing, assembly, and warehousing. The proposed church use would be permitted in the 1M zone subject to approval of a Hearing Examiner Conditional Use Permit. No rear or side yard setbacks are required unless the property abuts or is adjacent to a residential zone, and then a 50-foot setback is required. The rear property line is adjacent to parcels zoned RM-F; therefore a 20-foot rear yard setback is required for the subject site. The existing structure complies with all of the setback requirements. The Medium Industrial (1M) zone does not have a maximum lot coverage for buildings. The current building footprint of the structure is approximately 32,917 square feet, which equates to a building lot coverage of 24.3% (building footprint of 32,917 square feet / lot size of 135,285 square feet = 24.3%), which complies with the building lot coverage requirements. Buildings in the Medium Industrial (1M) zone do not have maximum building height limit. The applicant was not required to submit building elevations, as the proposed church will be located within an existing building. Therefore, staff was unable to determine the height of the building, however the submitted photograph indicates that the existing building is 2 stories. The existing structure complies with the height requirements. No exterior building alterations are proposed as part of this conditional use permit. (2) COMMUNITY NEED: There shall be a community need for the proposed use at the proposed location. In the determination of community need, the Hearing Examiner shall consider the following factors, among all other relevant information: (a) The proposed location shall not result in either the detrimental over concentration of a particular use within the City or within the immediate area of the proposed use. The immediate vicinity of the subject site is primarily surrounded by various commercial (office buildings, restaurant/lounge, etc.), industrial (warehouses, Renton School District maintenance shop, etc.), the Burlington Northern Railroad right-of-way, and multi-family residential uses. There are no other churches in the immediate vicinity, therefore the proposed Joyful Life church would not result in a detrimental over concentration of a church use in the area. Furthermore, as the proposed church is to be located within a multi-tenant office building and would conduct services outside of normal office business hours, the proposed church use is not expected to dramatically increase noise, odor, traffic, or produce other adverse impacts to surrounding properties. (b) That the proposed location is suited for the proposed use. The subject site is located within an industrially zoned area of Renton and is primarily surrounded by various commercial and industrial uses. A multi-family residential development is adjacent to the north of the subject site, however the Burlington Northern Railroad right-of-way separates the subject site from the residential development. Therefore, the proposed Joyful Life church is not expected to adversely impact neighboring properties. In addition, the proposed church would be located within an existing multi-tenant office building and would hold services on Sundays from 10:30 am to 12:30 pm and from 6:00 pm to 8:00 pm, which are outside of normal office business hours thereby reducing the impact of the church use on other uses within the office building. (3) EFFECT ON ADJACENT PROPERTIES: The proposed use at the proposed location shall not result in substantial or undue adverse effects on adjacent property. The following site requirements shall be required: (a) Lot Coverage: Lot coverage shall conform to the requirements of zone in which the proposed use is to be located. The 1M zoning deSignation has no maximum building coverage requirements. Building heights should be related to surrounding used in order to allow optimal sunlight and ventilation, and minimal obstruction of views from adjacent structures. Buildings in the Medium Industrial (1M) zone do not have maximum building height limit. The applicant was not required to submit building elevations, as the proposed church will be located within an existing building. Therefore, staff was unable to determine the height of the building, however the submitted photograph indicates that the existing building is 2 stories. (4) COMPATIBILITY: The subject property is located within a predominantly commercial, industrial, and multi- family residential area and is surrounded by commercial and multi-family buildings. The church proposes to hold church services on Sundays from 10:30 am to 12:30 pm and from 6:00 pm to 8:00 pm, which are outside of normal office business hours for other uses within the vicinity. Some of the impacts to adjacent properties staff expects from the proposed church use are short term traffic and noise impacts on Sundays prior to and after the church services as members of the congregation arrive, gather, and depart from the subject site. Staff considers the proposed church to be compatible with other existing uses in the immediate vicinity of the project as the church would be located within an existing multi-tenant office space, near other high intensity uses, and proposes to hold church services at dissimilar hours from other businesses in the project vicinity. (5) PARKING: The applicant has indicated that they have a congregation size of approximately 50 people. The applicant has also indicated that the congregation has the potential to grow to a total of approximately 150 people with approximately 75 people attending each church service. The site plan submitted by the applicant shows 315 on-site parking spaces 14 of which are handicap accessible spaces. The existing 315 parking spaces for the 67,260 square foot structure results in a ratio of 4.69 stalls per 1,000 square feet. RMC 4-4-080F requires that religious institutions provide 1 parking space for every five seats, provided that there shall be a minimum of 10 spaces provided. The applicant has indicated that approximately 25 people would be attending each church service. 25 seats would result in a requirement for 5 parking spaces, however a minimum of 10 spaces must be provided. The subject site's 315 available parking spaces are adequate to support the church use. In addition the proposed church services would be conducted on Sunday's outside of normal office business hours, which reduces the church's impact on the existing parking facilities. According to RMC 4-4-080.F.10 the parking requirements for a religious institution are less than the requirements for a professional office. Therefore, the impact of the proposed church on the existing parking lot is not likely to exceed the impact of the previous office use. The southern property line of the subject site fronts on SW ih Street. As previously stated, church services will be held on Sundays from 10:30 am to 12:30 pm and from 6:00 pm to 8:00 pm, outside of normal office business hours. The timing of these services is such that the traffic impact resulting from the proposed church use would not negatively impact on the surrounding uses as many of the surrounding uses operate during the day. (7) NOISE, GLARE: Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas, outdoor recreational areas and refuse storage areas. Activity on Sunday for two church services would create some limited traffic and noise impacts. However, these impacts are expected to be limited to prior to and after the church services as congregation members arrive, gather and visit, and depart. Staff does not expect any short-term construction noise as no construction improvements are proposed to the existing building. In addition, the proposed church services would be held on Sundays outside of normal business hours and would therefore minimize the short-term noise and traffic impacts generated by the church use. Finally, light and glare should not be an issue as the building is existing and no exterior alterations are proposed as part of this conditional use permit application. Separate tenant improvement and sign permits would be required prior to any building modifications. (8) LANDSCAPING: Landscaping shall be provided in all areas not occupied by building or paving. The Hearing Examiner may require additional landscaping to buffer adjacent properties from potentially adverse effects of the proposed use. This subject site is currently developed; staff does not anticipate the need for additional landscaping at this time. (9) ACCESSORY USES: Accessory uses to conditional uses such as day schools, auditoriums used for social and sport activities, health centers, convents, preschool facilities, convalescent homes and others of a similar nature shall be considered to be separate uses and shall be subject to the provisions of the use district in which they are located. There are no accessory uses proposed. The proposal is to operate church services at the subject location on Sundays from 10:30 am to 12:30 pm and from 6:00 pm to 8:00 pm. The church currently has a congregation size of approximately 50 people. (10) CONVERSION: No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is brought into compliance, with the provisions of this Chapter. The applicant proposes to convert an office space within a multi-tenant office building into a church. The applicant proposes to keep the existing office space as a B-Occupancy (office space) while the assembled church group remains less than 50 people at one time and to change the occupancy to A-3 Occupancy when the assembled church group increases to more than 50 people. (11) PUBLIC IMPROVEMENTS: The proposed use and location shall be adequately served by and not impose an undue burden on any public improvements, facilities, utilities, and services. Approval of a conditional use permit may be conditional upon the provision and/or guarantee by the applicant of necessary public improvements, facilities, utilities, and/or services. As the subject site is existing and fully developed, no additional street or utility improvements are required as part of the proposal. Utilities Staff has indicated that all existing public utilities are currently sufficient to serve the proposed development associated with this conditional use permit. G. It makes use of existing infrastructure and facilities that are not normally used during weekends or evenings. The existing two-story building is pre-improved and has substantial existing parking. Objective LU-X: Site religious facility with convenient transportation access and minimal impacts on adjacent land uses (existing building, has parking, street access and transit). Policy LU-105: Parking is provided on-site and is buffered with existing landscaping and topography from adjacent uses. Policy LU-325: Site provides for shared off hours on-site parking Church use will also support nearby restaurants, shopping, and other existing commercial businesses in the area by bringing people to this location on weekends. B. Community Need Community need is reflected in the growth of this young church and the religious diversification of the community. This church's congregation currently consists of 25 to 50 members, with potential to grow to 150 members. C. Effect on Adjacent Properties Property to the east of this existing office building is the Renton School District's administrative offices; to the west is an office building; to the south are office/warehouse buildings; and abutting to the north is a railroad spur and two (2) sets of tracks with existing residential, apartments, and condominium north of the tracks. The church's use would not have significant negative impact on the adjacent properties. Existing lot coverage, yards, height of structure would not change and complies with the current city zoning code. D. Compatibilities The proposed church use is compatible with the diverse character of the surrounding area, and is compatible with existing office uses within the building. The church and office functions occur at different times. Existing restroom facilities, parking, and access on the property can adequately serve both church and office functions. 500 Building, T.I. -Joy Life Churc 500 SW ih Street Renton, WA LPN Project No: 05022 E. Parking Access to the facility is by existing driveways off of SW th Street. The existing site is parked with 315 stalls at a ratio of 4.69 stalls/1 ,000 SF. A religious service of 25 people would require, per code, 1 stall per 5 seats, which equals 5 parking stalls, but the code also requires a minimum of 10 stalls. If service attendance tripled, adequate parking spaces would still be available on this property. The weekend use of on-site parking makes efficient use of the existing infrastructure. F. Traffic Traffic would not be impacted as functions occur during the weekends and early evenings when this area is relatively quiet (the office and warehouse businesses in adjacent spaces or buildings are not normally open). There is an existing transit access along SW 7th Street, (a minor arterial) and a few blocks west at Rainier Avenue S. G. Noise/Glare No significant change in noise or glare would occur, as this building exists. Vehicles would not generate significant noise to affect adjacent properties. The residential areas to the north are buffered from the site by existing railroad tracks and an existing hill. All worship services will occur within the building. H. Landscaping Existing mature landscaping would not be altered. I. Accessory Use The proposed church use has no accessory use and the 1,982 square foot space is contained within the existing improvements of this office building. J. Conversion The facility will accommodate the church use without conversion other than minor normal tenant improvements within the building interior. Use would remain a B-Occupancy (same as office) as long as assembled church group is less than 50 people at one time. If congregation or service size should increase an A-3 Occupancy would apply. The proposed church use is permitted as a conditional use granted by the Hearing Examiner and is to comply with the requirements of the 1M zoning district. Development Standards: The subject site is currently developed with an existing structure along with associated parking and utility improvements. The proposed change of use would require the existing structure to be brought into compliance with all Fire Safety and Building Occupancy requirements. Access/Parking: Access to the structure is from existing driveways off of SW 7'h Street. Any change to the driveway is to comply with the driveway design standards of RMC4-4-0801. The submitted materials indicated that the number of parking spaces allocated to the existing structure is 315 and that approximately 25 people per service would be using the space on Sundays. Parking regulations require a specific number of off-street parking stalls based on the amount of square footage dedicated to specific uses. Parking requirements may be based on one of the following uses: Religious Institutions: 1 for each 5 seats in the main auditorium, however, in no case shall there be less than 10 spaces. For all existing institutions enlarging the seating capacity of their auditoriums, 1 additional parking space shall be provided for each 5 additional seats provided by the new construction. For all institutions making structural alterations or additions, which do not increase the seating capacity of the auditorium, see ·outdoor and indoor sports arenas, auditoriums, stadiums, movie theaters, and entertainment clubs". 5 parking spaces would be required if 25 seats were provided for the 25 people that may be using the site, it appears that the subject site would have adequate parking for the proposed church. Sensitive Areas: The City's Critical Areas Maps indicate the site is located in a seismic hazard area. The seismic hazard is related to potential liquefaction of soils during an earthquake event. Based on the proposal, additional studies related to this hazard would not be required for the existing structure unless the structure would undergo exterior modifications or additions. Permit Requirements: The proposal would require approval of a Hearing Examiner Conditional Use permit. The review process would require a public hearing and would be completed in an estimated time frame of 8-10 weeks once a complete application is accepted. The application fee for the Hearing Examiner Conditional Use would be $2,000. Detailed information regarding the land use application submittal is provided in the attached handouts. Conditional Use Criteria: In order to obtain approval of a conditional use and expansion of the conditional use, the proposal must satisfy specific criteria. The purpose of a conditional use permit is to allow certain uses in districts from which they are normally prohibited. The evaluation of the proposed use must be deemed consistent with other existing and potential uses within the general area of the site. It is the applicant's responsibility to adequately demonstrate the facts justifying the approval of the conditional use permit based on the use's compatibility with ALL of the following criteria (RMC section 4-9-030G): • Comprehensive Plan • Community Need • Effect on Adjacent Properties, including lot coverage, yards and height • Compatibility • Parking • Traffic • Noise, Glare • Landscaping • Accessory Uses • Conversion • Public Improvements The criteria listed above must be clearly and thoroughly substantiated.
