Remove the City of Renton Seal (upper left-hand comer of drawing sheet). Note encroachments, if any. Are four signature lines needed under the "DECLARATION" block? Change references from "BOUNDARY LINE ADJUSTMENT" to LOT LINE ADJUSTMENT in the "DEDICATION" block, and elsewhere as needed. The "OLD" should be removed from the legal descriptions block (said legals are EXISTING). The references to LOT "A" and LOT "B" (under the legal descriptions block) should also be removed, and used only for describing the reconfigured lots. When the subject lot line adjustment is recorded, then the two resulting properties can be referenced as Lot "A" and Lot "B" of the lot line adjustment. A Report and Decision addressing both requests was issued on November 14, 2005, and was mailed to you on the same date. For the lot line adjustment, please submit two sets of an original mylar of the lot line adjustment and a check for $15.73 made out to CD&L for shipping, at the Development Services counter on the sixth floor of Renton City Hall. The mylars will be sent to King County for recording. Please verify that the mylars have been signed by all owners of record and have been notarized with an ink stamp (not embossed). Project Description / Background: The applicant is requesting an administrative lot line adjustment to correctly reflect the location of two existing single-family residences on adjacent lots, located at 614 and 618 S. 15th Street. Both lots have access from S.15th Street, which will not be altered by the lot line adjustment. The houses are currently located so that the line between the two lots bisects both houses. The applicant has been informed by a title company that resolution of the lot line issue is necessary in order to sell the individual properties. The proposed lot line adjustment will reorient the lots so that each house is sited on an individual lot without encroachments. The proposal also requires an administrative variance from the 60-foot minimum lot width standard that applies within the Residential - 8 units per acre (R-8) zone, for the proposed lot width of 50 feet for a corner lot. No development or other change to the subject properties is proposed with this application. The development standards of the R-8 zone as they pertain to this property require a front yard setback of 15 feet, a side yard setback of 5 feet (interior lot) or 15 feet (lot abutting a street), and rear yard setback of 20 feet. Minimum lot dimensions are 5,000 sq. ft., with 50- foot width for an interior lot and 60-foot lot width for a corner lot, and 85-foot lot depth. The proposed lot line adjustment would create two lots that are 50 feet wide and 80 feet deep. Lot B, which is located on the corner of S. 15th Street and Smithers Ave. S., requires a 10- foot variance from the minimum lot width standard and an 8-inch variance from the rear yard setback standard. Findings 1) Request: The applicant has requested a lot line adjustment to correctly reflect the placement of two existing single-family residences on adjoining lots. Currently, the property line between the two lots bisects both houses. The lot line adjustment will locate each house on a single lot without encroachments, and provide each lot with a legal description that is consistent with the existing development. The applicant has also requested approval for an administrative variance from the required 60-foot minimum lot width and 20-foot rear yard setback in the R-8 zone, for the property located at 618 S. 15 Street. A 50-foot lot width and 19 feet 2 inch rear yard setback is requested for this lot. This request reflects the current configuration and location of the existing single-family house. 2) Administrative Lot Line Adjustment: The applicant's administrative lot line adjustment submittal materials comply with the requirements necessary to process a lot line adjustment. The applicant's site plan is provided as Exhibit 2. 3) Administrative Variance: The applicant's administrative variance submittal materials comply with the requirements necessary to process a variance. 4) Existing Land Use: Land uses surrounding the subject site include: North: single- family residential (R-8); South: S. 15th Street and single-family residential (R-8); East Smithers Ave. S. and single-family residential (R-8); and West: single-family residential (R-8). 5) Zoning: The site is located in the Residential - 8 units per acre (R-8) zone. The allowable density range in this zone is 4-8 du/acre. The applicant proposes a net density of 11.11 du/acre; however, this net density is based upon existing development that is non-conforming with current lot size requirements, and does not reflect any change or intensification of density as a result of the proposal. Within the R-8 zone, maximum lot coverage is 50%; the applicant's proposal will result in approximately 35% lot coverage based on the existing single-family residences. The development standards of the R-8 zone as they pertain to this property require a front yard setback of 15 feet, a side yard setback of 5 feet (interior lot) or 15 feet (lot abutting a street), and rear yard setback of 20 feet. Minimum lot dimensions are 5,000 sq. ft., with 50-foot width for an interior lot and 60-foot lot width for a corner lot, and 85-foot lot depth. The proposed lot line adjustment would create two lots that are 50 feet wide and 80 feet deep. Both the existing and proposed new lots would be 4,000 sq. ft. each. Two single-family residences are currently on the site. The house on proposed Lot A is 696 sq. ft. and the house on proposed Lot B is 1,064 sq. ft. No alterations or expansions of the houses are proposed as part of the applicant's development proposal. The proposed reorientation of the lots will require that Lot B grant a sanitary sewer line easement to Lot A. The proposed 5-foot sewer line easement is shown on the site plan (Exhibit 2). When title to either lot is transferred to another owner, the applicant will be required to record the easement with the King County Recorder's Office concurrent with the transfer of title. CONSISTENCY WITH VARIANCE CRITERIA Section 4-9-250B.5.a. lists four criteria that the Zoning Administrator is asked to consider, along with all other relevant information, in making a decision on an Administrative Variance application. The Zoning Administrator shall have authority to grant an administrative variance upon making a determination, in writing, that the conditions specified below have been found to exist: a. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: The applicant contends that special circumstances apply to the subject site, which impose limitations on the lots and create a hardship. If the lots are reoriented as proposed, a variance is required for the lot width and rear yard setback for Lot B, based on the location of the existing house on the lot. However, the applicant indicates that the current orientation of the lots, with both houses being bisected by the line between the lots, prevents either property from being sold because the titles are affected by the encroachments. The applicant requests that the lots be reoriented to site each existing house on an adequate lot that does not contain encroachments and can be sold. The proposed lot line adjustment is a logical revision for these two lots, which will correctly reflect existing development, resolve the lot encroachment issues, and allow the applicant to sell the subject properties. No additional development is being proposed, and the requested variance will reflect only existing conditions and the redrawn lot lines without creating more density or intensity of use. The applicant has sufficiently demonstrated a hardship (inability to sell the properties) that can be resolved by approval of the lot line adjustment and associated variance. b. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The proposed reorientation of the lots will not affect neighboring properties, as no material changes will result to the existing single-family residences or the subject properties. The proposed lot width of 50 feet for a corner lot (Lot B) is currently non-conforming within the R-B zone, but the proposal will not increase the amount of non-conformity as the existing lots are also 50 feet wide. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The approval of the variance request would resolve a situation (encroachment) in a manner that would also be available to other property owners in the vicinity, based on similar circumstances. d. That the approval as determined by the Zoning Administrator is a minimum variance that will accomplish the desired purpose: Staff concurs with the applicant's assertion that the proposed variance is the minimum necessary to resolve the encroachment issue between the two lots. There is no other feasible lot configuration that could serve the applicant's needs and correctly reflect existing development, without creating further deficiencies regarding the established development standards. E. Conclusions 1. The subject site is located at 614 and 618 S. 15th Street, within the R-8 zoning designation. 2. The applicant is requesting a lot line adjustment to reflect the existing development on the subject properties, and to enable the properties to be sold. The lot line adjustment is a logical corrective action that will not have any negative impacts on surrounding properties. 3. The R-8 zone requires a minimum 60-foot lot width for corner lots and a minimum 20- foot rear yard setback. For Lot B, the applicant is requesting an administrative variance for the proposed lot width of 50 feet, and the proposed rear yard setback of 19 feet 2 inches. The request for the administrative variance has been analyzed according to the four variance criteria described above. The variance request meets all four criteria for granting the variance, in that it meets the hardship test, the public welfare test, the special privilege test, and the minimum variance test. The applicant is currently unable to sell the properties because of the encroachment issues, which creates a hardship. No negative impacts to surrounding properties would result from the combined effects of the requested lot line adjustment and requested variances for lot width and setback. The proposed method of resolving the encroachment issue through a lot-line adjustment and associated variances for existing development would also be available for other property owners in the vicinity, in similar circumstances. The proposed lot line adjustment and associated variances reflect the minimum action necessary to resolve the identified issues. The lot line adjustment is not subject to appeal. An appeal of the variance decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). An appeal to the Hearing Examiner is governed by Title IV, Section 4-8-11.B, which requires that such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must be made in writing on or before 5:00 PM on November 30, 2005. Any appeal must be accompanied by a $75.00 fee and other specific requirements. THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals to the Hearing Examiner as well.
