described as follows, to-wit: �

Line in iovern:nent Lots 6 �d 7 of Section 18, Township 23 :Tortn,
Ran�e 5 �ast of the ::illa*�ette :_eridian, in the City of �enton,
Kzn�; County, State of ?-Tasrington, indicated b�l �.ED color on the
Railway Company�s map dated I•far. 23, 1951�, revised 10-13-��., �
identified as �xhibit ",�t�, at�ac'.�ed hereto and :nade a part hereof.
Sub���ct to easements, permits, leases and licenses her�tofore �ranted
by the�a,i.lway Company upon, across or alonc said rignt of way.
This grant is made upon the following terms: •
1. The street �}�� shall be construoted and ma.intained in a good and worlananli.ke manner and made
and kept as safe for public travel as possible. The expense of construction and maintenance thereof shall
be borne by the grantee; and the Railway Company shall not be liable for or assessed for any of the ex- �
pense of construction or maintenance.
2. Should the right of way, the right to use which 'is hereby granted� or any portion thereof� be
required for the construction of tracics, buildings including public or private warehouses� or for other
railroad purposes, the Railway Company may upon ninety (9�) days' notice in writing revoke this
permit, and the grantee hereby agrees in that event to peaceably and promptly surrender possession of
I the premises unto the Railway Company on the expiration date fixed in the notice, and if requested by
the Railway Company will restore the premises to their original sta.te.
3. The grantee shall not grant to any person or company permission to construct or maintain a pole
I line on any portion of the above described right of way and the Railway Company reser•ves to itself the
right to grant such permits provided the pole lines are so located as not to interfere �vith the use of
the street � for public travel.
1�. The �rantee sha11 at its expense provide and maintain a barricade at the easterly
line of the above-described premises op�;osite the �.ailTr�ay Company�s bridge �do. 2 over the I
Gedar River to prevent the use of said bridge by ven.icles as an underpass.
5. The grantee shall at its expense provide and z�aintain a barrier along the easterly
Iine of the southerly 310 feet, more or less, of sai_d premises, indicated as ".�arking
Area'T on �h.�.bit ttA.'�, to prevent vehicles from �ain� upon the i�ailway Company�s ri�ht
of wav easterly of said line.
IN FYITNESS WHEREOF, the parties hereto have executed these presents in duplicate originals this
