Warren, City Attorney RE: Easement for Telephone Lines/Poles and Underground Conduit/Cables on Renton Municipal Airport Dear Gail : I have reviewed the undergrounding ordinance, Chapter 23 of Title IV of the city code, at your request . You ask if the city' s undergrounding ordinance supersedes the easement for the overhead telephone lines . The question cannot be answered unless I know what further action would be necessary by the telephone company. If the system is to be rebuilt then city code section 4-23-3 .A. 1 may trigger undergrounding. That section defines rebuilds as a replacement of overhead facilities for the distance of three or more spans or five hundred feet exclusive of replacement due to casualty damage. A later subsection, subsection 3, defines relocations as removal of existing facilities with subsequent • reinstallation at an adjacent location generally necessitated by road widening projects . If either one of these definitions fit what the telephone company will be doing with these overhead • telephone lines, then the undergrounding ordinance would be triggered. You then . inquire as to whether or not there would be need for a separate easement . I believe that there would be. An aerial easement and an underground utility easement are not the same. We also have to look at practicality. For example, if the lines cross the Cedar River and they can't be hung under a bridge, it is unlikely that tfie city would want to require undergrounding as � that would require going under the river. As a final matter, you mention sharing the easement language with the telephone company and the state UTC. I would suggest that you do so. Warren, City Attorney RE : Easement for Overhead Telephone Line and Underground Conduit Dear Gail : I am enclosing a copy of Auditor' s File No. 3337990 . This is the easement from the Defense Plant Corporation to Pacific Telephone and Telegraph. Paragraph 2 of the document gives the telephone company a perpetual easement for construction, operation, maintenance, inspection, reconstruction and repair of an underground conduit and cable line starting at the point of termination of the easement described in paragraph 1 of the document and proceeding in a southeasterly direction 1, 174 feet (the exact bearing is given) , and then describes a curved line to the location of a telephone pole . The only question that this easement presents is one of location. Is this the same location as the conduit across the airport? I assume that it is . This document is rather emphatic in giving a perpetual easement . The document also gives the phone company substantial rights concerning the telephone poles, and again gives a perpetual easement for overhead telephone lines under paragraphs 1 and 3 of the easement. You will find enclosed a copy of the easement . I am furnishing a copy of this letter and easement to the city clerk for city records .
