Sai d heretofore menti oned grantee, i ts successors or assi gns, shal l
have the right, wlthout prior notice or proceeding at law, at such times as
may be necessary to enter upon said above described property for the purpose I
of constructing, maintaining, repairing, altering or reconstructing said
utllity, or making any connections therewith, without incurring any legal
�bligations or iiability therefore, provided, that such construction, main-
taining, repairing, altering or reconstruction of such utility shall be
accomplished in such a manner that the private improvements existing in the right
right(s)-of-way shall not be disturbed : or damaged, or in the event they ar�
di s turbed or damaged, they wi 11 be rep1 aced i n as good a condi ti an �s :they were
immediately before the property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the �aforedescribed premises, '
including the right to retain the right to use the surface of said right-of-way
if such use does not tnterfere with installation and maintenance of the utility
line. However, the grantor shall not erect buildings or structures over, under
� or across the right-of-w�y during the existence of such utility.
� This easement, sAall be a covenant running with the land and shall be bind-
a ing on the Grantor� his successors , heirs and assigns. Grantors covenant that
Qthey are the lawful owners of the above properties and that they ave a good and
� lawful right to execute this agreement.
