HomeMy WebLinkAboutContract iT CAG-01-155 AGREEMENT GCA 2798 SR 169 Maple Valley Highway HOV/Queue Jump THIS AGREEMENT, made and entered into this '15 day of 0 — 20 d l , between the STATE OF WASHINGTON, Department of Transportation, acting by and through the Secretary of Transportation, hereinafter called the "STATE", and the City of Renton, 1055 South Grady Way, Renton, WA., hereinafter called the "CITY", WHEREAS, the CITY is planning construction or improvements under a project entitled "SR 169 Maple Valley Highway HOV/Queue Jump," hereinafter called the "PROJECT", and in connection therewith, the CITY has requested that the STATE participate in the PROJECT as herein described, and WHEREAS, the STATE is willing to commit matching funds to the CITY for the preliminary engineering phase of the PROJECT, and WHEREAS, it is the intent of this AGREEMENT to be supplemented in the future to provide for the construction of the PROJECT, and NOW, THEREFORE, by virtue of RCW 47.28.140, and in consideration of the terms, conditions, covenants, and performances, contained herein, or attached hereto and incorporated and made a part hereof, IT IS MUTUALLY AGREED AS FOLLOWS: I GENERAL The CITY, shall act as lead agency in developing the preliminary engineering and environmental documentation for the PROJECT, as outlined in Exhibit "B", Scope of Work, attached hereto and by this reference made a part of this AGREEMENT. The CITY, through it's Consultant Perteet Engineering Inc., shall prepare environmental documentation which will meet the requirements of the National Environmental Policy Act (NEPA), State Environmental Policy Act (SEPA), all required permits, an approved design file, plans, specifications and estimate (PS&E), and the right-of-way plans for the PROJECT. 2798.02.agr.doc 1 1 Plans, specifications and cost estimates shall be prepared by the CITY in accordance with the current State of Washington Standard Specifications for Road, Bridge, and Municipal Construction, and amendments thereto, and adopted design standards, unless otherwise noted. I I PAYMENT The STATE, in consideration of the faithful performance of the work to be done by the CITY, agrees to reimburse the CITY for the actual direct and related indirect costs, up to but not to exceed $300,000, or 50% of total costs, whichever is less as shown in Exhibit "A," Estimate of Cost, attached hereto and by this reference made a part of this AGREEMENT. Partial payments shall be made by the STATE, upon request of the CITY, to cover costs incurred. These.payments are not to be more frequent than one (1) per month. It is agreed that any such partial payment will not constitute agreement as to the appropriateness of any item and that, at the time of final audit, all required adjustments will be made and reflected in a final payment The CITY agrees to submit a final bill to the STATE within forty-five (45) days after the CITY has completed the work. III EXTRA WORK In the event unforeseen conditions require an increase in the cost from that agreed to on Exhibit "A", this AGREEMENT will be modified by supplemental AGREEMENT covering said increase. In the event it is determined that any change from the description of work contained in this AGREEMENT is required, approval must be secured from the STATE prior to beginning such work. Where the change is substantial, written approval must be secured. Reimbursement for increased work and/or a substantial change in the description of work shall be limited to costs covered by a written modification, change order or extra work order approved by the STATE. 2798.02.agr.doc 2 GCA 2798 f ' r IV RIGHT OF ENTRY The STATE hereby grants and conveys to the CITY the right of entry upon all land which the STATE has interest, within or adjacent to the right of way of the highway, for the purpose of performing the preliminary engineering under this AGREEMENT. V LEGAL RELATIONS Each of the PARTIES to this AGREEMENT shall protect, defend, indemnify, and save harmless the other PARTY, its officers, officials, employees, and agents, while acting within the scope of their employment as such, from any and all costs, claims, judgment, and/or awards of damages, arising out of, or in any way resulting from, each of the PARTY's negligent acts or omissions. No PARTY will be required to indemnify, defend, or save harmless the other PARTY if the claim, suit, or action for injuries, death, or damages is caused by the sole negligence of the PARTY. Where such claims, suits, or actions result from concurrent negligence of the PARTIES, the indemnity provisions provided herein shall be valid and enforceable only to the extent of the PARTY's own negligence. Each of the PARTIES agrees that its obligations under this subparagraph extend to any claim, demand, and/or cause of action brought by, or on behalf of, any of its employees or agents. For this purpose, each of the PARTIES, by mutual negotiation, hereby waives, with respect to each of the other PARTY only, any immunity that would otherwise be available against such claims under the Industrial Insurance provisions of Title 51 RCW. In the event that any of the PARTIES or combination of the PARTIES incurs any judgment, award, and/or cost arising there from, including attorneys' fees, to enforce the provisions of this Section, all such fees, expenses, and costs shall be recoverable from the responsible PARTY or combination of the PARTIES to the extent of that PARTY's/those PARTIES' culpability. This indemnification shall survive the termination of this AGREEMENT. 2798.02.agr.doc 3 GCA 2798 V1 VENUE In the event that any party deems it necessary to institute legal action or proceedings to enforce any right or obligation under this AGREEMENT, the PARTIES hereto agree that any such action or proceedings shall be brought in a court of competent jurisdiction situated in Thurston County, Washington. May 22, 2001 GCA 2798 EXHIBIT "B" SCOPE OF WORK SR169-Maple Valley Highway HOV/Queue Jump PURPOSE AND BACKGROUND Purpose This Scope of Work outlines the city-state partnership entered into by and between the Washington State Department of Transportation (STATE), the City of Renton (CITY) for work through 100% design. Background The Arterial HOV project was initiated in support of Renton's Comprehensive Plan. The Comprehensive Plan includes an HOV element that identifies several corridors and interchange locations as candidates for HOV treatments. Maple Valley Highway was one of the corridors chosen. This study evaluated a corridor between Sunset Boulevard North on the west and 140th Way S.E. on the east. SCOPE OF WORK The work includes preparation of construction documents and right-of-way plans for the project, in addition to required environmental documentation. Prior to receiving authorization to proceed with the final design the consultant will perform preliminary studies to examine alternatives and determine the preferred configuration for the project. These will include alternatives for the location of signals and provision of access to adjoining properties east of the 1-405 northbound ramps; alignment of the widened highway; and, consideration of potential impacts upon park/recreational facilities. The scope of the construction includes the following: transit priority for all intersections; HOV lanes; a west bound right turn lane and transient queue jump at the 1-405 north bound on ramp; east bound right turn lane; and transit-only queue jumps at the 140th Way S.E. connection. Involvement/Participation Project Management The City of Renton will take the lead and manage the project through the design stage and construction at such time as funding becomes available. Design Responsibility A consultant firm will be hired to perform the preliminary design, and to develop contract plans, specifications and estimate (PS&E). 2798.02.ExhbtB.rtf 1 GCA 2798 Project Review City of Renton, Washington State Department of Transportation (WSDOT) staff, King County staff, and private utilities will be able to review the plans at the 30%, 60% and 90% completion stages. Private and Public Utilities will be given the opportunity to coordinate their upgrades to existing facilities. ' 2798.02.ExhbtB.rtf 2 GCA 2798 EXHIBIT "B" Detailed Scope of Work City of Renton SR 169 Maple Valley Highway HOV/Queue Jump INTRODUCTION III The objective of the project is to design and construct high occupancy vehicle (HOV) queue dumps and bypass lanes and provide transit priority traffic signal improvements on the Maple Valley Highway (SR 169) at 140th Way S.E. and east of the 1-405 northbound freeway ramps. The project involves roadway widening at intersection approaches and modifications to channelization and traffic signals and also includes widening to improve the northbound on- and off-ramp movement at the 1-405/SR 169 interchange. The project will further develop alternatives recommended in the "Arterial HOV Project Pre-Design Report" prepared by PBQD in February, 1997. Specifically, the concepts shown on Figure 12b as Alternative 6 on will be developed in the 1-405/SR 169 interchange area. At the present time, it is unknown if the widening for HOV lanes at 1- 405 will be uniformly about the existing road centerline, or if widening will occur all on the south or north side of SR-169. This will be determined during using results of the traffic study and the technical design charrette process. The concepts shown on Figure 10a as Alternative 4 & 6 will be developed at the SR 169 / 140th Way SE intersection. Transit signal priority will be installed along SR 169 at the following six intersections: Houser, Sunset Boulevard, 1-405 ramps, Park Place, SE 131St, and 140th Way SE. The project will be developed in a format suitable for City advertisement and award. WSDOT must approve the channelization plans and traffic signals. It is anticipated that King County will also have some approval authority over the improvements at 140th Way SE. The services under this agreement will be accomplished under three phases: Phase 1 - Design and Environmental Studies, and Preparation of PS&E Phase 2 - Right-of-way plan preparation & acquisition (requires supplement) Phase 3 - Services during construction (requires supplement) The fee for services during right-of-way acquisition and acquisition, and for services during construction will be negotiated during or following the completion of the project design when these elements of the work can be more accurately identified, and will be included as a supplement to this agreement. 2798.02detai1.ExhbtB.doc 3 GCA 2798 SCOPE OF SERVICES PHASE 1 — DESIGN STUDIES AND PREPARATION OF PS&E General 1. PROJECT MANAGEMENT 1.1 Schedule and coordinate with consultant and subconsultant personnel and equipment. 1.2 Coordinate and attend monthly Technical Advisory Committee meetings during the design studies portion of the project, and prepare meeting minutes. 1.3 Prepare, monitor, and update project schedule. Monitor project budget. 1.4 Prepare monthly billings, progress reports, and updated monthly project schedule. 1,5 Attend bi-weekly coordination/discussion meetings and other meetings as needed, and prepare meeting minutes. 1.6 Other management activities as needed to fulfill the requirements of this agreement. 2. PROJECT COORDINATION/PLANNING This element of the work includes efforts to coordinate the project development with all known project stakeholders. Known stakeholders include City Public Works, Parks, and Planning Departments, WSDOT, King County, Shari's Restaurant, Silver Cloud Inn, Stoneway and various public and private utilities. 2.1 Facilitate a project kickoff meeting with the consultant team, city staff, and representatives from WSDOT and King County. The purpose of this meeting is to determine issues, procedures, and processes to be followed in development of the project. 2.2 Arrange and facilitate a technical design charrette that will focus on development of alternative solutions to the design and environmental issues on the SR 169 / 1- 405 project. 2.3 Coordinate with City Parks Department to minimize impacts and maximize benefits to Cedar River Park. 2.2 Assist the City in coordination with WSDOT, King County, and King County Transit. 2.3 Assist the City in organizing, staffing, and conducting a community information program to include one open house meeting with interested citizens. Provide presentation graphics for this public presentation. The City will provide all advertisements, mailings and will arrange for meeting rooms and refreshments as necessary. 2.6 Meet individually with representatives with Shari's Restaurant, Silver Cloud Inn, and Stoneway to keep them informed of the project progress. (9 meetings assumed) 2798.02detai1.ExhbtB.doc 4 GCA 2798 2.7 Present the project to the City Council or appropriate Council committee at least two times during the project development. 2.8 Coordinate with various public and private utilities along the route. Prepare and maintain utility coordination checklist. Coordinate and attend utility meetings. Review utility records and identify utility conflicts. 2.9 Provide, through subcontract, geotechnical studies, landscape architecture services, and preliminary costs for acquisition of right-of-way. 2.10 Other coordination and lannin activities p g a es as needed to fulfill the requirements of this agreement 3. TRAFFIC STUDY This work includes an analysis to evaluate the existing and future traffic conditions (year 2020) along the project corridor and recommend roadway alternatives for evaluation by the design charrette process. 3.1 Gather and review existing studies and reports prepared for the project site and vicinity. 3.2 Obtain existing traffic count information from City, WSDOT, and County files. The City will provide any required additional traffic counts. 3.3 Obtain future traffic volumes from the City's EMME/2 model. 3.4 Perform manual adjustment of the model output as necessary to correct for location of zone centroids, link connectors, etc. 3.5 Perform SYNCHRO analysis and VISSIM simulation for existing and future conditions. 3.6 Review three-year accident history for the two project sites, and propose improvements that could enhance safety at any high accident locations. 3.7 Prepare signal warrant analysis as required by WSDOT for modifications to existing signals. 3.8 Analyze the impacts of the proposed improvements on transit and HOV operations. Recommend solutions that will enhance those operations. 3.9 Identify traffic impacts to existing and planned non-motorized facilities. 3.10 Suggest channelization and widening alternatives that should be considered for more detailed study for use at the design charrette. 3.11 Upon selection of a construction alternative by the City, prepare a traffic analysis report that summarizes the results of the above work. 3.12 Other traffic study efforts as required to culminate in a traffic analysis report summarizing the study and identifying a successful solution. 2798.02detai1.ExhbtB.doc 5 GCA 2798 4. SURVEYING Perteet Engineering will provide control surveys and limited ground based topographic mapping completion surveys. Aerial photogrammetry will be provided by DeGross Aerial Mapping, and will include digital orthophotography and digital aerial mapping. Surveying will be sufficient to complete the project design, and will as a minimum include the following. 4.1 Control Surveys: Control surveys for the project will include datum control surveys, pre-marks for aerial photogrammetry, ground control for topographic completion surveys and control surveys for road right-of-ways. Datum control surveys will be to provide the project in Washington State Plane Coordinate System (WSPCS), North Zone (NAD 83/91) horizontal datum.; and North American Vertical Datum (NAVD 88). We will identify or establish approximately 10 horizontal control points and 7 vertical benchmarks for the project. Aerial photogrammetry `pre-mark' control spacing will be coordinated with our subconsultant as needed for 1" = 400' photo scale and 1" = 20' mapping scale. Control surveys for right-of-way will be limited to WSDOT monumentation for SR 169 and SR 405, and local monumentation for 140th Way SE. 4.2 Topographic Mapping Completion Surveys: In areas where the ground is obscured on the aerial photography, ground based topographic surveys may be required. These surveys will be provided with the same level of detail and to the same map accuracy standards as the aerial photogrammetric mapping. In addition, ground based topographic surveys will be included to supplement the aerial photogrammetric mapping for key vertical elements. These include storm drainage & sanitary ewer structures limited ry , paving edge profiles, limited road crown P rofles, limited curb line profiles and limited drainage corridor profiles. 4.3 Aerial Photogrammetry: 4.3.1 Digital Orthophotography SR 169 / Bronson Way Project Orthophoto Limits 2798.02detai1.ExhbtB.doc 6 GCA 2798 Digital orthophotography will be provided from the confluence point of Cedar River and SR 169 at the 'south end' of the project to 500' west of Hauser Way on the `north end' of the project. This digital orthophotography will be approximately 1000' wide. In addition, this orthophotography will include an approximately 1000' wide strip centered on the easterly margin of 1-405 extending from the SR 169 limits to approximately 100' north of NE 3rd Street. SR 169 / 140th Way SE Project Orthophoto Limits Digital orthophotography will be provided from 1000' south of 140th Way SE on the 'south end' of the project to the north end of the bridge crossing the Cedar River at the 'north end' of the project. This digital orthophotography will be approximately 1 000' wide. This digital orthophotography will be provided at the following specifications: Color imagery @ 0.4'pixel resolution. 4.4 Digital Aerial Mapping Aerial mapping will be provided for a 200' strip of the digital orthophotography, 100 feet on either side of the road surface centerline. This digital aerial mapping will be at a scale of 1" = 20' and include DTM generated 1'contours. All topographic features, which are clearly visible and identifiable to the stereo plotter operator, will be shown on the mapping. PHASE 2 - RIGHT-OF-WAY PLAN PREPARATION (REQUIRES SUPPLEMENT) The fee for services during right-of-way acquisition and acquisition will be negotiated during completion of the project design when this element of the work can be more accurately identified, and will be included as a supplement to this agreement. The City will be responsible for supplying title reports and for acquisition of new right-of-way. The following describes a typical scope of services for this phase of the work. 1. Order and provide copies of title reports for each parcel along the corridor where right-of-way is to be obtained. Invoices for the title reports shall be sent directly to the City for payment. 2. Prepare final right-of-way plans in accordance with WSDOT standards. 3. Prepare parcel maps for use in the negotiation process. 4. Provide marking or staking of the right-of-way to be acquired to assist the appraisal and negotiation process. 5. Prepare legal descriptions of required takes. 6. Attend bi-weekly meetings with the City during the negotiation process. 7. By qualified subconsultant, prepare appraisals of the right-of-way acquisitions required to construct the project. Consultant will assist the right-of-way appraisers and negotiators as may be necessary to define the extent of takings and to prepare possible mitigation measures. Services to acquire property through condemnation shall be considered as extra work. PHASE 3 - SERVICES DURING CONSTRUCTION (REQUIRES SUPPLEMENT) Phase 3 of this project will authorize construction engineering.
