Said heretofore mentioned Grantee, its successors or assigns, shall have the right, without prior notice or proceeding at law, at such times as may be necessary to enter upon said above described pennanent easement for the purpose of constructi ng, mai ntai ni ng, repai ri ng, alteri ng or reconst ructi ng said uti 1 iti �s, or maki ng any connzcti ons therewith, without i ncu rri ng any 1 egal obl i gati ons or 1 i abi 1 ity theref rom, p rovi ded, that such const ructi on, mai ntai ni ng, repa i ri ng, al teri ng o r reconst ructi on of sai d uti 1 iti es shal 1 be accomplished in such a manner that the private improvements existing in the easement area shall not be disturbed or damaged, or they will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantor shall fully use and enjoy the aforedescribed premises, i ncl udi ng the right to use the surface of said permanent easement if such use does not i nterfere with i nstal lati on and mai ntenance of the utilities. However, the Grantor shall not erect buildings or structures over, under or across the permanent easement during the existence of such utilities. This easement, shall be a covenant running with the land and shall be bi ndi ng on the Grantor, its successors, and assigns unless or until such time as the aforedesc ribed premises become abandoned with respect to said use for public utilities at which time the full rights of ownership without encumbrance of easements shall revert to the Grantor, its successors, and assigns. Grantors convenant that they are the lawful owners of the above properties and that they have a good and lawful right to execute this agreement.
