SLATER, husband and wife, hereinafter called 'G rantors", and the CITY OF RENTON, a Municipal Corporation of King County, Washington, hereinafter called "Grantee". _�.:,�.y`.;;.�, ,,�,�Y.�`T+ � li' WITNESSETH: F.'EI^r, c ,-;�-� l-:�;-}-i�-!,_ .+..•�,:,�::�,:t_..(�-�[t :.�r That said Grantor(s), for and in consideration of the sum of $�1 .00 �' paid by Grantee, and other valuable consideration, do by these presents, O grant, bargain, sell, convey, and warrant unto the said Grantee, its � successors and assigns, an easement for public utilities (including C� public access) with necessary appurtenances over, through, across and � upon the following described property in King County, Washington, more 1 particularly described as follows: � � � East 1/2 of Southeast 1/4 of Northwest 1/4 of Southeast 1//� of � Section 4, Township 23 North, Range 5 East, W.M. , less County Road. Permanent Easement Description: A strip of land 30 feet in width over, across and under the above d�scribed property, being 15 feet on each side of a centerline described in Attachment "A" which is by this reference made a part hereof. The City of Renton reserves the right to modify said centerline slightly during and or after construction to identify the centerline as constructed. Major realignment will be reviewed with the property owner prior to modif ication. To�ether With a Temporary Construction Easement Described as: A strip of land 5� feet in width being 25 feet on each side of centerline discribed in Attachment ��A", which is attached hereto and thereby made a part hereof. Said temporary construction easement shall remain in force duri.ng construction and until such time as the utilities and appurtenances have been accepted for the operation and maintenance by the Grantee but no later than December 31 , 1985. The aforesaid Grant of a Permanent and Temporary Construction Easements described above, is subject to the following conditions: 1 . Gran-tors, for a period of Ten (10) years from the date hereof retain the right to the merchantable timber within the area of the Easements granted hereby; provided Grantors shall effect no wood cutting or work within the area of the easements granted hereby during the period of construction thereon of Honey Creek Sewer Line. It is understood that Grantee does not hereby warrant or assure the legality of cutting and removal of inerchantable timber from the aforedescribed easement areas. A. The right to such merchantable timber shall be exercised by Grantors in the following manner: Trees to be cut and removed from the areas of the easements shall be marked by the Grantors, and Grantee timely notif ied of such marking. The Grantee shall thereafter effect the cutting of such marked timber and deliver the same to Grantors in the area of the location of their premises on Grantors� property contiguous to the easements hereby granted. 2. REti��1N,WA 9�f55 . � � � timber from their property; provided Grantors shall not make any such use duri.ng construction of the Honey Creek Sewer Line and said roadway in connection therewith and, further, Grantors shall be responsible for any and all damage to the maintenance road, sewer pipe, and/or armored river banks caused by the Grantors by reason of removal of inerchantable timber and/or use of such road. 3. The Grantors shall have the right to connect their contiguous property to the Honey Creek Sewer Line, subject to: (1 ) annexation of such contiguous property to the City of Renton (2) payment of the "Late Comer�s" fee as their share of the cost of the Honey Creek Sanitary Sewer Project, and (3) payment to the G rantee of applicable fees and icharges for such connection. �. The Grantee shall install (set) permanent markers at the corners � of the Permanent Easement area. i!'� t� Said heretofore mentioned Grantee, its successors or assigns, shall � have the right, without prior notice or proceeding at law, at such times � as may be necessary to enter upon said above described property for the :2 purpose of constructing, maintaining, repairing, altering or reconstruct- � ing said utilities, or making any connections therewith, without in- �p curring any legal obligations or liability therefore, provided, that such construction, maintaining, repairing, altering or �ec,onstruction of said utilities shall be accomplished in such a manner that the private improve- ments existi.ng in the right-of-way or on and within the property of Grantors contiguous to the right-of-way, shall not be disturbed or damaged. They will be replaced in as good a condition as they were immediately before the property was entered upon by the Grantee. The Grantors shall fully use and enjoy the aforedescribed premises, including the right to retain the right to use the surface of said right- of-way if such use does not interfere with installation and maintenance of the atilities. However, the Grantozs shall not erect buildings or structures over, under or across the right-of-way during the existence of such utilities. This easement, shall be a covenant running with the land and shall be binding on the Grantor� his successors, heirs and assigns.
