W. LOTTO, deceased, hereinafter called "Grantors" , and the CITY OF RENTON, a municipal corporation of King County, Washington hereinafter called "Grantee" . 0) � W I T N E S S E T H: � Said Grantors for and in consideration of Ten Dollars C'� ($10.00) and other valuable consideration, receipt of which � is hereby acknowledged, do by these presents grant, bargain, � c� sell, convey and confirm unto said Grantee its successors and � assigns an easement for sewer lines with necessary appurtenances over, through, across and upon the property described in Exhibit A attached hereto and incorporated herein by this reference, located in King County, Washington. Said property hereafter described as the "Easement Tract" . The Grantee, its ' successors or assigns, shall have the right without prior notice or proceeding at law at such time as may be necessary to enter upon the Easement Tract for the purpose of constructing, maintaining, repairing, altering or reconstructing the sewer line or making any connections therewith without incurring any legal obligation or liabili- ties therefore provided that such construction, maintenance, repairing, altering or reconstruction of said sewer line shall be accomplished in such a manner that the private improvements existing in or near the Easement Tract shall not be disturbed or destroyed; or in the event they are disturbed or destroyed they will be replaced in as good as condition as they were immediately before the Easement Tract was entered upon by the Grantee. The Grantors reserve the right to fully use and enjoy the Easement Tract, including the right to use the surface of the Easement Tract if such use does not interfere with the installation or maintenance of the sewer line, and so long as no permanent buildings or structures are erected on the Easement Tract. In the event of abandonment, vacation or relocation of the sewer line from or within the Easement Tract, the Ease- ment and all rights granted herein shall automatically revert to the Grantors, its' successors and assigns. This Easement shall be a covenant running with the land and shall be binding upon the Grantors' heirs, successors and assigns. Grantors covenant they are the lawful owners of the Easement Tract and they have good and lawful right to execute this Agreement.
