The Grantee, its successors or assigns, shall have the right, without prior notice or proceeding at law, at such times as may be necessary to enter upon the property described in Exhibit "A" hereto for the purpose of obtaining ingress and egress to the Ditch located on the property to the south of and adjacent to the Right of Way to carry out construction, maintenance, repair, alteration or reconstruction of the Ditch or other utilities thereon, or making any connections therewith and to allow the slope of the Ditch to be maintained on the Right of Way, without incurring any legal obligations or liability therefore, provided that the rights granted hereunder are exercised in a non-negligent manner and that such construction, maintenance, repair, alteration or reconstruction of the Ditch or utilities shall be accomplished in such a manner that the � private improvements existing in the Right of Way shall not be disturbed � or damaged and will be replaced in as good a condition as they were � immediately before the property was entered upon by the Grantee. 0 �j The Grantor shall fully use and enjoy the aforedescribed � premises, including the right to retain the right to use the surface of � Right of Way if such use does not interfere with the rights granted herein. � Reflection pools and appurtenant structures will be allowed in and over ,� the easement, and will not be considered a violation of this section. This easement, shall be a covenant running with the land and shall be binding on the Grantor, its successors, heirs and assigns. Grantor covenants that it is the lawful owner of the property described in Exhibit "A" attached hereto and it has a good and lawful right to execute this agreement.
