Werstiuk and his wife Gladys L. Werstiuk, are the owners of the following real property in the City of Renton, County of King, State of Washington, described as follows: Parcel A: West one-half of Block 55 in C. D. Hillman's Lake Washington � Garden of Eden Add. #1, according to Plat recorded in Volume 11 of Plats, � page 63, in King County, Washington. Except that portion thereof deeded � to King County for road by deed recorded under Auditor's File No. C:� 4156181. •,� � � Parcel B: All of Block 56 in C. D. Hillman's Lake Washington Garden "� of Eden Addition #1, according to Plat recorded in Volume 11 of Plats, � page 63, in King County, Washington, together with vacated alley in said block. Parcel C: That portion of abandoned Pacific Coast Railway right-of- way between 108th Place S.E. to the East line of Block 56 produced Southerly, in C. D. Hillman's Lake Washington Garden of Eden Addition No. 1, according to Plat recorded in Volume 11 of Plats, page 63, in King County, Washington. Except that portion of the West one-half of Block 55, C. D Hillman's Lake Washington Garden of Eden Addition #1 lying Northly of the North line of Block 56, said plat, produced Easterly to the East line of the West one-half of said Block 55. Wf�REAS, the owners of said property, hereinafter "the property," desire to impose the following restrictive covenants running with the land as to use, present and future, of the property; � NOW, THEREFORE, the aforesaid owners hereby establish, grant and impose restrictions and covenants running with the land as to the use of the land hereinabove described with respect to the use by the undersigned, their successors, heirs and assigns as follows: PERMITTED USE � Permitted uses of the property shall be limited to the uses allowed as follows: Parcel A shall be limited to single family uses allowed in the GS-1 Residence District of Section 4-729, Title IV, Ordinance No. 1628, I Code of General Ordinances, City of Renton, King County, Washington. The easterly 200 feet of Parcel B shall be limited to single family uses allowed in the 5R-2 Residence District of Section 4-705, Title IV, Ordinance No. 1628, Code of General Ordinances, City of Renton, King County, Washington. The remaining westerly portion of Parcel B, except for the easterly 200 feet, shall be limited to multiple family uses allowed in the R-2 Residence District of Section 4-708, Title IV, Ordinance No. 1628, Code of General Ordinances, City of Renton, King County, Washington. � Parcel C shall be limited to single family uses allowed in the R-1 Residence District of Section 4-706, Title IV, Ordinance No. 1628, Code of General Ordinances, City of Renton, King County, Washington. . . , ' , � f . . DEVELOPMENT I Development of the property shall be limited to residential dwelling units that are approved according to the procedure and requirements of Chapter 27, Renton Planned Unit Development Ordinance, Title IV, Ordinance No. 1628, Code of General Ordinances, City of Renton, King County, Washington; furthermore, said procedure shall insure compliance with the terms herein contained. Development shall not occur in the existing ravine beyond the 215-foot ground elevation. LAND5CAPED AREAS The westerly 15 feet of Parcels B and C and the southerly 15 feet of Parcel C shall be reserved for only landscaping which shall constitute an effective sight- Nobscuring buffer. �' VEGETATION PRESERVATION 0 '`D Clearing, grading, cutting or landfill operations shall not occur in the ravine � area, defined as lying below 215-foot ground elevation. In the remainder of the � property clearing or grading shall not occur beyond that approved under Chapter � 27 hereinabove described. � ACCESS , The southerly 25 feet of Parcel C shall be dedicated to the City of Renton, Washington for public right-of-way and said right-of-way shall be the only access from the property to Kennewick Place N.E. SETBACKS All buildings or structures shall be set back to 30 feet from the westerly boundary and 15 feet from the northerly boundary of Parcel B and 25 feet from prior southerly boundary of Parcel C, now consisting of a 20-foot setback from the new southern boundary of Parcel C and dedication of the former southerly 25 feet of Parcel C for public right-of-way purposes. , BUILDING DESIGN The architecture of all buildings shall be single family residential in character featuring appropriate and compatible materials. DURATION These covenants shall run with the land and expire on December 31, 2025. If at any time improvements are installed pursuant to these covenants, the portion of the covenants pertaining to the specific installed improvements as required by the Ordinances of the City of Renton shall terminate without necessity of further documentation. Any violation or breach of these restrictive covenants may be enforced by proper legal procedures in the Superior Court of King County by either the City of Renton or any property owners adjoining subject property who are adversely affected by said breach. Reasonable attorneys' fees incurred during an enforcerner�t proceeding I will be borne by the parties whom the court determines are in error and shall be entered as a judgment in such action. r z Iva G.
