Harper, are the owners of the following real property in the City of Renton, County of King, State of Washington, described as follows: That portion of Government Lot 9 and the Henry Meader �, Donation Claim No. 46, all in Section 25, Township 23 � North, Range 4 East, W. M. , described as follows: N � Commencing at the Northeast corner of said Section 25; � thence South 0° 49 '10" West, along the East line of said c� Section 25 a distance of 180. 01 feet to an intersection 0 with a line parallel to and 180 feet southerly, measured � at right angles to, the north line of said Section 25; f'� thence North 87° 12 ' 59" West, parallel with said North line, 20. 01 feet to an intersection with a line parallel to and 20. 00 feet Westerly, measured at right angles to the East line of said Section 25, said point being the True Point of Beginning; thence North 87�12 ' 59" West, ' parallel and 180. 00 feet Southerly of the North line of said section, a distance of 1026 . 07 feet; thence South 1 Ol ' 19" West 1095. 58 feet; thence South 88° 24 ' 48" East 1029. 43 feet to a point on a line 20 feet Westerly, measured at right angles to the East line of said Section 25; thence North 0°49 ' 10" East parallel to said east line ' 1074 . 19 feet to the True Point of Beginning. WHEREAS, the owners of said described property desire to i� impose the following restrictive covenants running with the land as to use, present and future, of the above described real property; NOW THEREFORE, the aforesaid owners hereby establish, grant and impose restrictions and covenants running with the land as to I use of the land hereinabove described with respect to the use by the undersigned, their successors, heirs and assigns , as follows : , GREENBELT Forty-foot greenbelt area of existing vegetation shall be set aside along the eastern property line. Any fill in this area is to be removed and the area regraded to the grdde c,i tlie draii�ay� �harir�el and hydr�seeu�a. If �ossi�le, i the toe of the landfill will not extend into this greenbelt. � Existing trees shall be retained in this area where practical. LANDFILL AND GRADING OPERATIONS Filling shall not occur in the P-1 and P-1 drainage channels. Any existing fill in these channels is to be removed and the area regraded to the grade of the drainage channel and hydroseeded. Existing vegetation is to be retained in these drainage channels. The entire regrading and landfill shall be hydroseeded as soon as possible after the completion of the grading, except for portions where existing vegetation is retained. Final approval of the engineering design and supervision of the grading and filling is required under Chapter 23, Title IV, Code of General Ordinances, Renton, Washington. Erosion control measures for utilization during grading and filling shall be approved by the Public Works Department to � afford maximum possible protection from siltation of 0 Springbrook Creek, and P-1 and P-9 drainage channels, and � the adjacent city wetlands area. � � Suitable dust control methods shall be utilized, including f�- r` watering of work areas per approval of the Public Works Department. STORP�I DRAINAGE Interim storm water retention shall be accomplished via construction of a two-foot berm around the top and perimeter of the site. VEHICULAR ACCESS Resolution by the aforesaid owners of permanent vehicular access to the property shall be accomplished prior to submittal for approval of the final development site plan. FINAL DEVELOPMENT APPROVAL Final approval of the uses and site plan for the property shall be required by the Hearing Examiner after conducting a public hearing. OTHER APPROVALS Final approval of the proposal by the Kinc� County Department of Hydraulics Division and Department of Ecology of the Flood Zone Control Permit shall be required. DURATION These covenants shall run with the land and expire on December 31, 2025. Any violation or breach of these restrictive covenants may be enforced by proper legal procedures in the Superior Court of King County by either the City of Renton or any property owners adjoining subject property who are adversely affected by said breach.
