may be necessary to enter upon said above described property for the purpose
' of constructing, maintaining, repairing, alteririy or reconstruct�ing said
utility, or making any connections therewith, without incurr�ing any legal
obl i gations or 1 i abi 1 i ty therefore, provi ded, Cliat such construc�iar�, main-
taining, repairing, altering or reconsi;ruction of sucf� utility shall be
accomplished in such a manncr that the pr�Pvate improvements existing in the right
right(s)-of-way shall not be disturbed or damagLd, or in the event they are
di s turbed or damaged, they wi 11 be repl aced i n as good a condi ti on as they tivere
imn�edi ately before the property was enter�d upon by the Grante�.
The Grantor shall fully use and enjoy the aforedescribed premises ,
. including the right to retain the right to use th� surface of said right-of-way
if such use does not interfere with installation and ii�aintenance of the utility
line. However, the grar�tor shall not erect buildings or structures over, und�r
or across the �right-of-way during the existence of such ut�ility.
This easement, shall be a covenant running w�ith the land and shall be l,ind- I
ing on the Grantor, his successars , heirs and assi�ns. Grantors covenant that
they are the lawful owners of the above properties ar�d that they have a good and
lawful right to execute this agreement.
