Colasurdo are the owners of the following real property in the City of Renton, County of King, State of Washington, described as follows: The south 55 feet of the following described property: �, The north 3/5 of the west half of the northwest quarter of the northwest � quarter of the northwest quarter of Section 15, Township 23 North, Range 5 OEast, W.M. , in King County, Washington. NEXCEPT the north 30 feet and the west 30 feet thereof for county roads, and except the south 12 feet of the north 42 feet of said north 3/5 0 conveyed to King County for S. E. 128th Street by deed recorded under � Auditor's File No. 5853034, and except the south 140 feet of the north 182 feet of the east 160 feet of the west 190 feet of said north 3/5 of the west half of the northwest quarter of the northwest quarter of the northwest quarter of said Section 15. WHEREAS, the owners of said described property, hereinafter "the property," desi're to impose the following restrictive covenants running with the land as to use, present and future, of the property. NOW, THEREFORE, the aforesaid owners hereby establish, grant and impose restrictions and covenants running with the land as to the use of the land hereinabove described with respect to the use by the undersigned, their successors, heirs and assigns, as follows: LIMITATION OF DEVELOPMENT Development of the subject property shall be limited to business or commercial uses enumerated for the B-1 zone in the City of Renton Zoning Code. These covenants shall run with the land and expire on December 31 , 2025. If at any time improvements are installed pursuant to these covenants, the portion of the covenants pertaining to the specific installed improvements as required by the Ordinances of the City of Renton shall terminate without necessity of further documentation. Proper legal procedures in the Superior Court of King County may be instigated by either the City of Renton or any property owners adjoining subject property who are adversely affected by any violation or breach of these restrictive covenants. Reasonable attorneys' fees incurred during an enforcement proceeding will be borne by the parties whom the court determines are in error and shall be entered as a judgment in such action.
