R-069-81 DECLARATION OF RESTRICTIVE COVENANTS WHEREAS, Julius Caraccioli , as his separate property, is the owner of the following real property in the City of Renton, County of King, State of Washington, described as follows: Located in the SW 1/4 of Section 19-23-5, portions of lots 8, 9, 10 and all of 4g, 50 and 51 of Hillman's Earlington Gardens #1 , Volume 17, page 74 of plats in King County, Washington, together with that portion of vacated Harriman Avenue (91st Avenue South) . WHEREAS, the owner of said described property, hereinafter "the property," desires to impose the following restrictive covenants running with the land as to puse, present and future, of the property; ll� O � NOW, THEREFORE, the aforesaid owner hereby establishes, grants and imposes O � restrictions and covenants running with the land as to the use of the land !�i � hereinabove described with respect to the use by the undersigned, his successors, heirs and assigns, as follows: ZONING REQUIREMENTS Development on the property must conform to all requirements of Section 4-730, M-P, Manufacturing Park District, of the City of Renton Zoning Code with the exception of rear yard and side yard setbacks. MAINTENANCE OF 100 YEAR FLOOD CAPACITY Maintenance of the 100 year flood capacity shall be required on the subject site including the holding capacity of the soils and subsurface of the site; this requirement to be in effect until such time as such capacity is no longer necessary as a result of a change in flood hazard. DURATION These covenants shall run with the land and expire on December 31 , 2025, or such time as the flood storage capacity required within this covenant is no longer necessary. Proper legal procedures in the Superior Court of King County may be instigated by either the City of Renton or any property owners adjoining subject property who are adversely affected by any violation or breach of these restrictive covenants.
