WHEREAS, Renton East, a partnership: is the owner of the following real property in the City of Renton, County of King, State of Washington, described as follows: PARCEL J The east half of the Southeast quarter of the Southeast quarter of the Southwest quarter of Section 10, Township 23 North, Range 5 East, W.M. , in King County, Washington: EXCEPT the South 50 feet thereof for road as conveyed to King County by deeds �recorded under King County Recording Nos. 5807910 and 5876168. �PARCEL K O �The West half of the Southeast quarter of the Southeast quarter of the Southwest 0 quarter of Section lU, Township 23 North, Range 5 East, W.M. , in King County, �"!Washington; �EXCEPT the South 200 feet of the West 200 feet thereof: AND EXCEPT the South 5U feet feet thereof for road as conveyed to King County by deeds recorded under King County Recording Nos. 5813071 and 5876169; AND EXCEPT the West 5U feet for road, the Easterly margin of_ which was established by deed recorded under King County Recording No. 5876169 WHEREAS, the owner of said described property, hereinafter "the property," desire to impose the following restrictive covenants running with the land as to use, present and future, or the property; NOW, THEREFORE, the aforesaid owner hereby establish, grant and impose restrictions and covenants running with the land as to the use of the land hereinabove described with respect to the use by the undersigned, their successors, heirs and assigns, as follows: REVERSION OF ZONING CATEGORY Upon adoption of an ordinance by the City Council, B-1 (Business/Commercial) zoning at eriod if a is approved for the property for a period of two years. During th p , building permit is not issued on the property, the zaning shall revert to its earlier G-1 classification. If the building permit granted in the two year period expires without being utilized as provided in the Renton Building Code, then the zoning shall revert to its earlier classification. DURATION These covenants shall run with the land and expire upon development of the property or reversion of the zoning to its earlier classification. Proper legal procedures in the Superior Court of King County may be instigated by either the City of Renton or any property owners adjoining the subject property who are adversely affected by any violation or breach of these restrictive covenants.
