DECLARATION OF RESTRICTIVE COVENANT
This Declaration of Restrictive Covenant ( "Declaration" ) is
made by Brian J. Maier ( "Declarant" ) as of this 14th day of
February, 1990.
Recitals
Declarant is the owner of certain real property located in
King County, Washington, and legally described on Exhibit A
attached hereto (the "Property" ) .
Declarant wishes to subject the Property to this Declaration,
NOW, THEREFORE, Declarant declares that the Property shall
be held, transferred, sold, conveyed, leased, used, and occupied
� � subject to the conditions and restrictions hereinafter set forth
�D which are for the purpose of protecting the value and
� desirability of, and which shall touch and concern and run with
� title to the Property and which shall be binding on all parties
Ohaving any right, title, or interest in the Property or any
� portion thereof, and their respective heirs, successors , and
' assi ns and shall enure to the benefit of each owner thereof .

1 . Approval for Use Changes . Prior to any modification of
the proposed use and/or any change of use of the Property, the
owner/occupier of the Property shall submit to the local agency
having jurisdiction, plans and other materials required for
environmental review and site plan approval .
2 . Hazardous Substances. The use, disposal, treatment,
generation, storage, and sale, of any substance designated as ,
or containing components designated as, hazardous, dangerous,
toxic , or harmful, and/or subject to regulation by any federal ,
state, or local law, regulation, statute, or ordinance as a
hazardous or similarly characterized substance shall be
prohibited on the Property.
3 . Bindinq on Successors . The covenants contained in this
Declaration are not personal , but shall run with the land and
shall be binding upon and enure to the benefit of Declarant and
its heirs , personal representatives , transferrees, or successors
in interest.
