SERVICE LINEN is the owner in fee of the following O described real property situated in King County, Washington: � � The East 90 feet of Lot 1 and all of Lots 2, � 19 and 20, Block 16, Town of Renton Addition � as per plat recorded in Volume 1 of plats, � page 135, records of King County, Washington. hereinafter referred to as Parcel A. B. Jassny/Raphael is the owner in fee, as tenants in common, of the following described real property situated in King County, Washington: The west 30 feet of Lot l, Block 16, Town of Renton Addition as per plat recorded in Volume 1 of Plats, page 135, records of King County, Washington; hereinafter referred to as Parcel B. C. Grantor is the owner in fee, as tenants in common, of the following described real property situated in King County, Washington: Lots 4 and 5, Block 19, Town of Renton Addition as per plat recorded in Volume 1 of Plats, page 135, records of King County, EXCISE TAX NOT REQUIRED IGng Co.Reoords Divislon �I' � �L�epury Washington; except the East 5 feet thereof, condemned in King County Superior Court Cause No. 93525 for alley, as provided by Ordinance No. 333 of the City of Renton; hereinafter referred to as the Substitute Easement Parcel. D. In 1985, SERVICE LINEN obtained from the City of Renton conditional use permits to allow for a minor addition to the SERVICE LINEN structure located on Parcels A and B. As part of its approval, the City of Renton required that SERVICE LINEN obtain additional parking, which it did, as was more particularly set forth in that certain Parking Easement and Agreement dated November 21, 1985, recorded under King County Auditor's No. 8512110625, which has been released pursuant to the sale described in Recital E below. E. Grantor was also the owner of the real property encumbered by the Parking Easement, has sold said real property and wishes to encumber the Substitute Easement Area under the terms and conditions provided herein so as to continue to provide ��d the additional parking required by the City of Renton, in � compliance with the terms of the conditional use permits. � NOW, THEREFORE, in consideration of the sum of TEN AND � NO/100 DOLLARS ($10. 00) and for other good and valuable � consideration, the receipt and sufficiency of which are hereby � acknowledged by the parties, the parties covenant and agree. for � themselves and all their future grantees, heirs, successors and � assigns as follows: l. Grant of Easement. Grantor hereby quitclaims, grants and conveys to SERVICE LINEN and to Jassny/Raphael a perpetual (except as set forth in paragraph 4 below) easement over and across the Substitute Easement Parcel for surface parking, for the benefit of Parcels A and B (the "Substitute Easement") . 2 . Use of Substitute Easement Parcel. The Substitute Easement Parcel shall be used for surface parking for the employees, agents, licensees, customers, suppliers and providers of SERVICE LINEN. 3 . Prohibitions on Use. Grantor shall not build, maintain or permit any use on the Substitute Easement Parcel during the term of the Substitute Easement which interferes with the use of the Substitute Easement Parcel described in paragraph 2 herein. 4. Term. This Substitute Easement shall be released and rescinded upon the request of the then owners of the Substitute Easement Parcel at such time as: (a) the City of Renton eliminates off-street parking requirements; (b) the improvements located on Parcels A and B are redesigned to provide all on-site - 2 - parking as required by the then-effective City of Renton ordinances; (c) other arrangements are made to provide for required parking for Parcels A and B; or (d) the present use of Parcels A and B is discontinued or abandoned. Any release or rescission under this paragraph is subject to the approval by the City Council of the City of Renton and such approval shall not be unreasonably withheld. 5. Purpose of Substitute Easement. It is the parties' intent in entering this Easement Agreement to assure that, so long as Parcels A and B remain in their present use and require off-site parking to meet City of Renton requirements, the Substitute Easement Parcel shall be used to provide the required parking. This Easement Agreement and the Substitute Easement created hereby shall be interpreted in conformance with this intent. 6. Successors and Assigns. The Substitute Easement and the rights and obligations conferred hereby shall run with the � land and shall inure to the benefit of and be binding upon the �,�` parties' respective heirs, successors and assigns, including, d, without limitation, all subsequent owners of Parcel A, Parcel B � and the Substitute Easement Parcel and all persons claiming under � them.
