That said Grantor for and in consideration of the sum of Ten Dollars paid by Grantee, and other valuable consideration, receipt of which is hereby acknowledged, does by these presents, grant, bargain, sell, convey, and warrant unto the said Grantee, its successors and assigns, a perpetual easement for a water line for domestic and fire protection, with necessary appurtenances, over, under, through, across and upon the following described property(the "Easement Area") in King County, Washington, as described in E�ibit A and depicted in Exhibit B. �,,� This easement is for the purpose of constructing, reconstructing, installing, repairing, t,� replacing, operating and maintaining a water line for domestic and fire protection, together � with the right of ingress and egress thereto without prior institution of any suit or � proceedings of law and without incurring any legal obligation or liability therefor. This ,� easement is granted subject to the following terms and conditions: fi'� ,� 1. Grantee shall, upon completion of any work within the Easement Area, restore the � surface of the Easement Area, and any private improvements disturbed or destroyed during execution of the work, as nearly as practicable to the condition they were in immediately before commencement of the work or entry by Grantee. 2. Grantor shall retain the right to use the surface of the Easement Area as long as such use does not interfere with the easement rights granted to Grantee. Grantor shall not, however, have the right to: a. Erect or maintain any buildings or structures within the Easement Area; or b. Plant trees, shrubs or vegetation having deep root patterns which may cause damage to or interfere with the water line to be placed within the Easement Area by Grantee; or c. Develop, landscape, or beautify the Easement Area in any way which would unreasonably increase the costs to the Grantee of restoring the Easement Area and any private improvements therein; or d. Dig, tunnel or perform other forms of construction activities that shall be done on the Easement Area which would disturb the compaction or unearth Grantee's facilities on the Easement Area, or endanger the lateral support facilities; or e. Grantee shall have the right to take samples in the Easement Area to make a determination, as Grantee deems appropriate, whether material encountered contains any hazardous substances. If Grantee takes any such samples, Grantee shall provide Grantor a copy of the sample results upon request. This easement shall run with the land described herein, and shall be binding upon the parties, their heirs, successors in interest and assigns.
