WHEREAS the Good Shepherd Group Home proposal at 10th and Olympia
Street,
Renton, WA, is being built upstream from BETHLEHEM EVANGELICAL
LUTHERAN CHURCH, located on the following described property:
The South 5 acres of the west half of the Northwest quarter less
the East 358 ft. less portion for the road coal/mineral rights.
Tax Parcel Lot No. 092305-9175-09, located at 1024 Monroe Av.
N.E. , Renton, WA; and
WHEREAS the drainage system is a 25-year rate drainfield
infiltration system that has been approved by the CITY OF RENTON,
Department of Public Works; and
WHEREAS, the following provides a statement of drainage release
from the downstream property owner, in this case, BETHLEHEM EVANGELICAL
LUTHERAN CHURCH;
NOW, THEREFORE, BETHLEHEM EVANGELICAL LUTHERAN CHURCH of Renton,
WA, a non-profit corporation, its successors, assignees, or heirs,
Shall and hereby releases and discharges the CITY OF RENTON from r
any and all liability for all loss, damage, or destruction of the said
facility of BETHLEHEM EVANGLICAL LUTHERAN CHURCH;
Shall and hereby does indemnify and save harmless the CITY OF
C) RENTON of and from any and all claims, demands, suits, actions, damages,
recoveries, judgments, costs, or expenses arising or growing out of or
in connection with such injury, death, loss or damage or destruction

BETHLEHEM EVANGELICAL LUTHERAN CHURCH further agrees to appear and
U0 defend in the name of the CITY OF RENTON suits or actions at law brought
against the CITY OF RENTON on account of such personal injuries, death,
or damage to property, and to pay and satisfy any final judgment that
may be rendered against the CITY OF RENTON in any such suit or action.
The liability assumed by BETHLEHEM EVANGELICAL LUTHERAN CHURCH herein
shall not be affected or diminished by the fact, if it be a fact, that
any such suit or action brought against the CITY OF RENTON may arise out
of the negligence of either, its officers, agents, servants, or be
contributed to by such negligence.
