On tIlkI�,L 4:s{** .nn DRAINAGE HOLD HARMLESS AGREEEMEN1 - 1+ THIS DRAINAGE HOLD HARMLESS AGREEMENT is executed by CROWN POINTE LIMITED PARTNERSHIP, a Washington limited part- nership (hereinafter "Crown Pointe") . RECITALS OD 1. Crown Pointe is the owner of the real property '4 located in the City of Renton described in Exhibit A, attached hereto and incorporated herein by this reference CD 4.4 (hereinafter "Property") ; to OD 2. Crown Pointe has applied to the City of Renton for a building permit to in order to construct a 198 -unit, multi-family housing complex with all related accessory uses on the Property; 3. Crown Pointe has agreed to construct storm drainage systems on the property to accept certain runoff water from adjacent property and/or public right-of-ways ("System") and the City of Renton has approved the System; and 4. Crown Pointe has agreed to maintain the System on the property as a private storm drainage system and hold the City of Renton harmless with respect to the maintenance of the System. NOW, THEREFORE, in consideration of the City of Renton issuing the building permit and not requiring a separate storm drainage system, Crown Pointe agrees as follows: 1 . Crown Pointe agrees to maintain the System on the Property and agrees to hold harmless the City of Renton from any claims, causes of action, damages, liability, loss, costs or expenses of any type or nature which may accrue to the City of Renton resulting from Crown Pointe failing to maintain the System on the Property in a reasonable manner, to include the cost of any suit or defense by the City of Renton. Crown Pointe shall, when it has obtained written notice from the City of Renton, assume and defend any such suit or action resulting from the lack of reasonable mainte nance of the System without cost or expense to the City of Renton, including the payment of any judgment or costs. This Agreement shall be binding upon Crown Pointe, its heirs, successors, and assigns, and shall be a covenant run- ning with the Property herein described. DATED this 6V day of gc44I-J , 1986.
