RELEASE AND INDEMNIFICATION AGREEMENT a THIS AGREEMENT made this14th day of May , 1980 , by and between the City of Renton, ("City" herein) , and the under- _ =D signed Developer of the Eastport Shores Condominium. CD A. The Developer is constructing the Eastport Shores Condo- minium,4� a condominium to be established pursuant to the Horizon- tal Properties Regimes Act (RCW Chapter 64. 32) located on that certain-teal property which is described in Exhibit A, attached hereto and incorporated by this reference herein (the "Property") . B. An Eight inch (8") ductile iron water main was installed on the south side of the Property, which installation was not in accor- dance with requirements and specifications set forth by the City. Said water main extends from the center line of Lake Washington Boulevard east approximately 250 feet, running parallel to the southern boundary of the Property. C. Developer has requested the City waive the requirements and specifications for the installation of said water main and the City has acceded to this request. In consideration therefore, De- veloper has agreed as follows : 1. Developer hereby agrees to assume all risk of loss , damage or injury which may result from the location and condition of said water main upon the Property; and the responsibility for all subsequent maintenance, repair and replacement of said water main. �r s9 !I ..m R'E .;� E'i �C i!ONS L .. . . , 2. Developer hereby releases the City from any and all liability for, and agrees to indemnify and save the City harmless CTS f`- from, any and all injuries to persons, property or otherwise, and 'd' 0" from any claims whatsoever, in any manner arising out of the loca- L!") tion and/or condition of said water main and/or arising from the O CD OD necessary repair, maintenance or replacement of said water main. 3. This document shall be binding on the heirs , successors and/or assigns of Developer and further shall be expressly made an obligation of the Owner' s Association of the Eastport Shores Condo- minium by the Declaration of Covenants , Conditions and Restrictions to be recorded for said condominium; it is understood that upon the recording of said Declaration, that Developer' s liability hereunder shall cease and said Association shall assume and thereafter perform all of Developer' s obligations hereunder.
