COMPANY ("Seattle Times") , a Delaware corporation, in favor-6 " the CITY OF RENTON, a Washington municipal corporation ("City") . ( 1. Wetlands Monitoring Access. To implement Condition 6 of the Mitigated DNS for its project, Seattle Times hereby grants to the City an access easement for annual monitoring and inspection by the City of Wetland A and Wetland B and their respective buffers as described in the City's site plan and ' related approvals under City File No. ECF; SA; SSM; SP-051-91. () The Easement area consists of the area occupied by Wetland A and .J Wetland B located on portions of the Property legally described V on Exhibit A attached hereto. Further, to the extent Wetland A and/or Wetland B cannot be reached from public streets or in sidewalks or other public access, then the City may have non- OD exclusive temporary access over paved or landscaped portions of j the Property required to reach those Wetlands. The City's access --- under this Easement shall be done at such times and in such cb in manner as to cause no or minimal disruption or disturbance of - Seattle Times' use, operation and vehicle access on the Property. 'N.„,_ Nothing in this Easement shall restrict or confine Seattle Times' C'1 access over or placement of buildings, structures, driveways, or C•1 other facilities or uses on the Property so long as consistent with City approvals under the above-referenced City File Number. 2. Hold Harmless. The City hereby releases Seattle Times and agrees to indemnify and hold Seattle Times harmless from any injury or death to persons or damage to the Property, including 8 Wetland A and Wetland B, and any improvements thereon, from any "; liability, suit, action, judgment or claim arising from the City's use of this Easement.
