HomeMy WebLinkAboutLA 9203170952 CAG 026-81 • • CU CITY OF RENTON I � MUNICIPALITY OF METROPOLITAN SEATTLE AGREEMENT FOR JOINT USE OF EASTSIDE INTERCEPTOR SEWER -- SECTION 2 2 THIS AGREEMENT, made and executed as of this 6j day of co co , 1981 , between the CITY OF RENTON , a municipal corporation of the State of Washington ( hereinafter referred to to as "the City" ). and the MUNICIPALITY OF METROPOLITAN SEATTLE, a :I metropolitan municipal corporation of the State of Washington ( hereinafter referred to as "Metro" ) ; WITNESSETH :H : OWHEREAS, the parties have heretofore entered into a long- term agreement for Sewage Disposal dated May 2, 1961 as amended 0 by supplemental agreement dated June 18, 1970 ( hereinafter together Cv referred to as the "Basic Agreement" ) ; and WHEREAS, in 1962 Metro constructed the Eastside interceptor Sewer -- Section 2 ( hereinafter referred to as the " Interceptor Sewer" ) to serve as a facility of the Metropolitan Sewerage System; and WHEREAS, the City desires to use a portion of the Interceptor Sewer as a Local Sewerage Facility in order to connect side sewers from park facilities in the City ' s Gene Coulon Memorial Beach Park; NOW, THEREFORE, in consideration of the mutual covenants contained herein, it is hereby agreed as follows : Section I . Definitions . The defined terms used in this agreement shall have the meanings set forth in the Basic Agreement . References to manhole numbers shall be to those manholes and numbers identified in Metro Contract Document No. 62-2 for con- - struction of the Eastside Interceptor, copies of which are on file with Metro and the City . MIPIPr-- 411 • M1 Section 2 . Joint Use of Interceptor Sewer. The City and Metro agree that the portion of the Interceptor Sewer between man- holes R02- 12 and R02- 15, as shown on Exhibit "A" attached hereto, shall serve as both a Metropolitan and Local Sewerage Facility . The City shall have the right to connect side sewers from City park facilities to said Interceptor Sewer at mutually agreed points between the designated manholes . For the right to make said connections, the City shall pay to Metro, before making the connections, the sum of $6 . 90 per front foot of property served on the west side of the Interceptor Sewer alignment.. Said amount represents one-half the estimated cost of constructing an eight- inch ( 8- inch ) local sewer on the same alignment as 'the Interceptor Sewer throughout that portion where the local connections are allowed . Upon payment of said amount, the City shall own one-half N of an eight- inch (8- inch ) equivalent share of the Interceptor CD Sewer along that portion where local service is provided . Prior CY-) to making said side sewer connections, the City shall submit to CV O Metro for approval , a plot plan indicating the length of frontage and the property to be served, and shall pay Metro the connection charges as specified . The City ' s side sewer connections to the Interceptor Sewer shall be made in the manner required by Metro' s Rules and Regula- tions . The City shall hold Metro harmless from any loss , cost, charge, liability or expense resulting from or arising out of damage to the Interceptor Sewer or to the persons or property of others related to or arising from, caused by the making of said connection or from the City ' s failure to observe any covenant of this Agreement, or from the City ' s construction , operation, and maintenance of the side sewers . Section 3 . Construction and Maintenance of Local Sewerage - Facilities . The City shall either construct, operate and maintain at its expense or cause others to construct, operate and maintain at their expense in a proper fashion, the side sewers from the City park facilities up to and including the tee connection to • • the Interceptor Sewer. Metro shall have no responsibility for construction, operation or maintenance of the side sewer or Local Sewerage Facilities . Section 4 . Maintenance and Operation of Interceptor Sewer. Metro shall continue to operate, maintain and own all portions of the Interceptor Sewer excepting as otherwise expressly provided herein . The City shall have no responsibility for operation or maintenance of the Interceptor Sewer; provided however that the City shall be responsible to repair any damage to the Interceptor Sewer caused by negligent construction, operation, and maintenance of the City ' s side sewers and tee connections . Section 5 . Basic Agreement Unchanged . The City shall comply with all provisions of the Basic Agreement without qualification fV Lr, or condition by reason of any provision or interpretation of this C ) CD Agreement, it being the intention of the parties that the Basic OAgreement shall not be affected or modified hereby .
