VOL �UPAGE 88 w. 330053f) PERMIT KNOW ALL MEN BY THESE PRESENTS: Q That The City of Seattle, a municipal corporation of the State of M Washington, hereinafter called the "CITY", does hereby grant to the City of 1/1 Renton, hereinafter called the "PERMITTEE", the right and privilege to use O and occupy that portion of the City's Skagit Transmission Line Right of Way O in Renton, King County, Washington, described as follows, to-wit: CD C) The west 10 feet and the north 30 feet of the following described tract of land: Beginning at the northeast corner of said NW4 of the SV-; thence south 0°05'56" east along the east line of said subdivision, 206.24 feet; thence south 46° 35'27" west 137.43 feet to the easterly margin of county road; thence northerl along said easterly margin 274.86 feet; thence north 46 35'27" east 36.47 feet to the north line of said NV of SW4-; thence easterly along said north line 73.46 feet to the place of beginning, being a portion of the NWi of the SWk of Section 8, Township 23 North, Range 5 East, W.M., in King County, Washington, for highway purposes in connection with the widening of Park Avenue and for an access roadway from the New Renton Highlands Housing Project to the Boeing Assembly Plant, and no others. Said permit is granted under the following terms and conditions to which the Permittee by its acceptance hereof specifically agrees: 1. The City reserves and retains unto itself the right to con- struct, reconstruct, relocate, operate and maintain its transmission lines and any future transmission lines upon., along or across said property and the construction, operation and maintenance of said improvements and the occupation and use of said right of way shall in no way interfere with the construction, operation or maintenance by the City of its transmission line system. 2. All cost and expense in connection with the construction or maintenance of said highway- located within the City's right of way shall be borne by the Permittee and any and all damage or injury done to the City's transmission line or system or any part thereof in the construction or main- ' tenance of said improvements shall be repaired and reconstructed and the cost of such repair and reconstruction shall be forthwith paid by the Per- mittee on demand. 3. The Permittee agrees to protect, indemnify and save harmless the City from any and all claims, actions or damages of every kind and descrip- tion which may accrue to or be suffered by any person or persons, corporation or property by reason of the construction, operation or maintenance of said highway or the use and occupation of said right of way by the Permittee or -1- - - tvot.2,120 t3t3 its agents and in case of any suit or action brought against the. City by reason thereof, the Permittee will, upon notice to it of the commencement thereof, defend such suit or action at its sole cost and expense and will fully satisfy any final judgment rendered adversely to the City in any such action. 4. This permit shall be subject to cancellation for failure of the Permittee to fully comply with the terms and conditions thereof or if at any time the use and occupancy of said right of way by the Permittee shall conflict with the use, operation and maintenance by the City of its transmission line system. The Superintendent of Lighting of the City shall be the judge as to the existence of any such conflict of use. IN WITNESS WHEREOF the City has caused these presents to be exe- cuted by its Superintendent of Lighting thereunto duly authorized pursuant to Ordinance No. 72456, this 23rd day of March, 1943.
