AN ORDINANCE OF THE CITY_ OF :RENTON,. WASHINGTON
VACATING A PORTION OF NO. 33RD PLACE
WHEREAS proper petitions for vacating a portion No. 33rd

Place, Renton, King County, Washington, were duly filed with the
S City Clerk on or about June 17 , 1977 and July 6 , 1977 , respectively,

and said petitions having been signed by owners representing more
• than two.=thirdb.:of the_.proper.ty abutting upon such street sought
to be vacated; and
WHEREAS the City Council by Resolution Nos . 2119 and 2123 ,
passed and approved June 27 , 1977 and July 11, 1977, respectively
and after due investigation, did fix and determine the 1st day
of August, 1977 at the hour of 8 : 00 P.M. in the City Council Chambers
of the City of Renton to be the time and place for a public hearing
thereon, and the City Clerk having given due notice of suchhearing
in the manner provided by law, and all persons having been heard
appearing in favor or in opposition thereto; and
WHEREAS the Department of Public Works and the Planning
Department of the City of Renton having duly considered said.
petition for said vacation, and having found same to be in the
public interest and for the public benefit, and no injury or
damage to any person or properties will result from such vacation;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY. OF RENTON,
WASHINGTON, DO ORDAIN AS FOLLOWS :
SECTION I: The following described porticbn of N. 33rd
Place, to•-wit:
See Exhibit "A" attached hereto and made
a part hereof as if fully set forth

BE AND THE SAME IS HEREBY VACATED, subject to payment
unto the City by Petitioner-owners of the amount of $4,546.27 which
said amount does not exceed 1/2 of the appraised value of the '
area hereinabove vacated.
t AND FURTHER SUBJECT to that certain "Declaration of
.Ct Restrictive Covenants" dated August 15 , 1977 , which is incorporated
11"'"` herein and made a part hereof as if fully set forth, and which
Declaration is recorded in the office of Director of Records and
Elections , King County Receiving No.. 7708160763 ; AND SUBJECT to
retention of public easement as described on Exhibit "B" .
SECTION II : This Ordinande shall be effective upon its
passage, approval and five days after its publication.
A certified copy of this Ordinance shall be filed with
the Office of Records and Elections , King County, and as otherwise
provided by law,
PASSED BY THE CITY COUNCIL this 10th day of October, 1977 .

REVISED LEGAL DESCRIPTION
August 11 , 1977
All that portion of N. 33rd Place having a width of 50 feet, lying southerly
CV of the south line of Block 3 and northerly of the north line of Block 4,
0 C. D. Hillman' s Lake Washington Garden of Eden Addition No. 1 as recorded in
Volume 11 of plats, page 63, records of King County Washington; and also
lying easterly of the easterly right-of-way margin of Lake Washington Blvd.N.
(N extended, and westerly of the westerly right-of-way margin of Burnett Ave. N.
extended.
Except therefrom all that portion of said N. 33rd Place described as follows:
Beginning at the NW corner of Lot 4, Blk. 4, C. D. Hillman's Lake Washington
Garden of Eden Add. No. 1 , thence east along the north line of said Lot 4 a
distance of 10 feet;
Thence north perpendicular to the north line of Lot 4 a distance of 25 feet
to the centerline of N. 33rd Place;
Thence westerly along said centerline to an intersection with the south-
westerly extension of the easterly right-of-way margin of Lake Washington
Blvd. N. ;
Thence southwesterly along the extension of the easterly margin of Lake
Washington Blvd. N. to the NW corner of Lot 5, Blk 4;
Thence easterly along the north line of said Lot 5 and its easterly extension
to the NW corner of Lot 4, Blk 4, C. D. Hillman' s Lake Washington Garden of
Eden Add. No. 1 and the point of beginning.

The City of Renton requires an easement be retained for public utilities
including water and sewer with necessary appurtenances over, through,

more particularly described as follows:

A strip of land 30 feet in width, the north line of which lies 10 feet north
(\J of and parallel with the centerline of North 33rd Place, and the south line
of said strip lies 20 feet south of and parallel with the centerline of
�.. N. 33rd Place; lying easterly of the easterly Right-of-Way line of Lake
Washington Blvd. North, extended and westerly of the westerly Right-of-Way
line of Burnett Ave. N. , extended.
Said Right-of-Way of N. 33rd Place as platted between Blocks 3 and 4,
